enjoylife,

If you have a very straightforward case then there is no need for an attorney. If however you can afford one and are a bit paranoid then by all means go for it. An attorney's presence during interview time will keep the interviewer in check , barring him or her from asking irrelevant questions or by asking you to sign any waivers that are not in your interest etc.

If you are concerned about your wife's overstay then go ahead and let an attorney help you in preparing the N400 and take one to the interview. Simple overstays are usually "forgiven" by marriage to a USC. But the complex ones can cause problems.

Having an attorney is great, as it gives you peace of mind and buys you some insurance against CIS abuse. However...

It all boggles down to one question: Are you willing to pay $$ for a lawyer's presence during your interview.

enjoylife,
Rahul Kumar has said it all here for your case.
you have two possible problems here.
1. too many speeding tickets
2. your wife's overstay.

My personal view is you may be better off retaining a lawyer for the interview adnd bear some cost. If denied N 400, it will cost you much more.
And by-the-way you may have carried "enjoylife" little too far looking to all speeding tickets! so may be you have to pay some cost now!!

Recently I was in a Oath Ceremony for my friend and two people were pulled out of the ceremony because of the trafic/parking tickets. The officer on duty said that if you have a proof of payment and you were not arrested, I can allow you right now. He gave them new dates for oath right there. Personally I think trafic tickets w/o arrest will not bar you becoming citizen.

this is getting ridiculous. I do not doubt your information yet you do not probably know the details. But if the oath was denied because of traffic violations this is a disgrace for USCIS and serious ground for a law suit.

1. One should be allowed to proceed to an oath if interview went well. This is the last time USCIS have to say something, they should check the data well and make the decision than during the interview, rather than humiliating the person. They had plenty of time to schedule the interview and verify everything and request more evidence.

2. USCIS should have the facts if somebody is arrested, not to ask the people ready to give oath to provide an evidence if they are arrested. The fact that some officer said I will let you take the oath if you provide me with an evidence is extremely unprofessional. Also, providing prove on traffic violations is ridiculous. I have some from 8 years ago and more and of course do not keep record of it.

Nobody has ever said that traffic violation tickets should be kept. Many people do not even remember how many traffic tickets they had. I honestly do not believe USCIS will make a decision to bar somebody to take the oath on a basis of traffic violations.
