Since my I-485 application was filed 30 days ago on June14th and reached nebraska on Jun15th, I called USCIS today and spoke to representative for receipt numbers.
First one transfered me to another representitive.
She said they did not accept my application since there are no more visa numbers available.
I told that we have mailed it on June 14th and received on June 15th when visa dates were current to my priority date (04/2002).
She replied that it does not matter and I have to wait until October. She said if my application was not entered into systems by July 2nd then it would be rejected.
What a big mess.
Who is correct??
I do not want to make panic any one.
But if you were not in system until yesterday and find it in systems today or after today PLEASE PLEASE update me.

I think she is wrong.

I have been calling to find out my receipt numbers everyday since the past 3 days, and they were very nice and polite. I was informed that since there was an overload in the number of applications they received, there is infact a delay in sending out Receipts. She also told me that they were at this point in the process of sending out receipts for cases received in the 2nd week of June. She also mentioned that they are working weekends and they are hoping to send out most receipts of applications received in June by the end of the month.
Just so you know, my case was recd. on the last date they were accepting applications and I expressed the same concern, whether it will be processed. The lady said that as long as it was recd. on the date i should be fine.
So now there is no real way of know who is telling the truth, but I want to remain hopeful.

p.s. you can check to see if your checks were cashed, if so i was informed you can get your receipt. number from the back of the check.

Please do not panic!

Many people as in the same situation as you are. I called a couple of times in th elast three days. I talked to very knowledgeable people who assured me that all application receivedin June will be entered in the system. If they were file at TSC receipts will be sent by July 20th. For NSC receipts will be sent by July 2nd. With all due respect, that guy you talked with seems a bit ignorant of what is going one. Keep the hopehigh.

I wouldn't rely on any information that the customer support folks dish out. I personally know that they know nothing about what they are talking. We had my H1 Extn filed, but haven't got the receipt before my earlier I-94 expiration. When I called them I was told to leave the country immediately, since I am out of status and all. 3 weeks after calling USCIS Customer Support, I got the receipt with RD as the date when the application was delivered to them, which means what the customer support person told me was not true.

I would say wait for the day when they send you the receipt notice or the day when the checks are cashed.

Here is my details:

485 Filing Date: June 11 (received by USCIS)
Center : NSC
EB Type :EB3
PD: September 2002

But in USCIS website, it says they received my application on july 3rd. So do i have to consider July 3rd as my receipt date or Notice date?

The information you received from the USCIS representative is erroneous; I believe that her message should have been that if your case is not entered into the system as being received before July 2, then it would be rejected. Your priority date was current in June and we have FedEx confirmation of your AOS delivery on June 15 at the Nebraska Service Center, so your case should eventually be receipted in -- receipts are taking much longer than usual (6+ weeks), due to the volume of June filings. The immigrant numbers did not become unavailable until July, so cases that were current in June/filed in June are not to be impacted by the visa bulletin. As notes below, the retrogression means that your case would not be processed until your priority date is current again, but it does not mean that it won't be accepted as filed. We hope to have more information on the status of visa numbers in the next 24 hours and will disseminate it appropriately.

I was in the same boat as you but when I called up the UCSIC they gave me my reciept number. They are defenetely sending receipts for all the applications they recieved in June as couple of my other friends also got their recipt numbers by calling the 1-800 numbers. Most of them applied around June 15th.However my application is transfered to TSC center(my lawyer sent it to NSC) and it is mentioned in my case status that my application was recieved on july 9th(at TSC) even though my application was recieved at NSC on june 15th.

I spoke with the USCIS representative and found that my case was not entered into the system (I-485 application was sent on June 14th).

I spoke with my lawyer and got the same reply that 'asnmurty' got from his (or her) lawyer.

Looks like we need to wait for another couple of weeks.
 
Phone Response at USCIS

Hi Guys

Please be Patient. I called USCIS and spoke with an IO. He told me that it takes 45days to process the application from the date of delivery in the USCIS to encash the money and send the receipt notice.

Let us wait and see.

NSC is going slow ...

I called the 1-800 number they are very polite and apologized for the delay in sending receipts. She told me that they received lots of applications, and they are doing their best to process them as early as possible.

Before that I called my lawyer's office, they told me that after long time the INS opened the gates, and lots of people filed, so it may take time to get the receipts.

Just be patient ...
 
Hm... so if somebody's PD was let's say December 1, 2006 (EB-3 skilled worker) and this person sent I-485 to USCIS on June 19, 2007 (documents received June 20, 2007) so this person's documents were sent correct/on time? Even if Visa Bulletin with Eb-3 Current was valid for July 2007 but you sent the documents in June 2007, the documents will not be rejected? Am I correct?

I assume the whole issue of having the I-485 received before July is only of importance for people from countries were retrogression applies. I am from Europe, and I think there is no retrogression for European countries as of now.
Is that correct that it does not matter for countries with no retrogression?

a person who sends his doc any time in June,07 but dates were not current -will definately be rejected. E.g witha PD of Dec,6 EB3 it was not current in June,2007 so it has to be rejected.

same situation here..Mine was received by NSC via FeDex on 6/15/07 ...Thus far , no news

The way I read the July Visa Bulletin update, there are NO visa numbers available, regardless of the nationality of applicant. They will stop accepting any more applications starting July 2nd.
