Hello Friends,

Me and my spouse attended the CP interview on March 27th 2003. during interview consular officer refused under 221(g) becasue of lack of documents from the employer. all my original documents are still with consulate. Right now I am India working for the same employer....since I am in the project I could not able to go to the consulate before 1 year with all the documents.

I am planning to go to the consualte in April 2004. but my question is

My spouse becasue of her personal reason she wanted to stay in india for another year and she doesn't want to travel for another year. when I go to the consulate can I ask the consular officer to issue the visa me alone. I hope I can get it alone for right now...and I can send my spouse to consualte whenever she is ready........
do I need to carry any additional documents for this or do I need to carry the Packet IV application again for this
anybody had this problem.....please guide me on this.

I am sorry to hear about your case rejection.

Can you be more clear this rejection,on which document was missing?

You could take your wife for the interview.And you can entry US after stamping and delay your wife trip so that she can enter US separetly but within 6 months.

Yes, it was my bad luck.....Actually the documents were asked from my employer... like company existing pfoor

but My wife is not in a position to travel for another year...so that is the reason I wanted to ask the consular officer to issue visa alone to me.

I sent an query to consulate..they replied me back saying that
I can alone get a visa now and she can attend the interveiew later with the updated documents and I have to repay visa the fee. but I am thinking do I need to get any additional documents. so any idea on this. Please let me know.

Go alone to the cp interview carrying the needed employer documents. Inform the consular officer citing the reason why your spouse would like to postpone her interview. She should try to get an interview within 365 days of your interview date. Once your cp is approved leave a copy of your immigrant visa approval with your wife and later after you enter usa mail her the i-551 stamp copy from your passport along with green card copy so that when she goes for her interview in next 1 year she will have all necessary documents.

1. Do they send any oppointment letter again for the interview I hope I don't need it....I can walk in with refusal letter.
2. Do I need to carry again packet IV application.......
3. I think I have to get updated medical test, Police certificate,
4. I think I have to pay visa processing fee again.....I had already paid when I attended the interview on march 27th 2003.

any additional documents do I need to carry...Please guide me on this.

Answer: Normally you are supposed to return with required evidence within 365 day of the originally scheduled interview (is my impression). Since this is a unique case your best option is to call the consulate and as for instructions!

Answer: Not sure about this! I would think you do not have to pay coz your case was refused due to incomplete documentation. - so why should one have to pay twice since really $335 is for the CP process which in your case stands incomplete as of today. Again best option to ask the consulate.

3. Also they have mentioned I have to carry the documents which are mentioned in OF-194....do yo have any Idea about OF-194???

Could you please let me know what are the Packet IV doucments I have to carry again. I hope DS 230 II is the part of Packet IV and any other documents....

Since I am in india right now working for the same employer.....do I need to carry any additional documents.

Answer: Make sure ds 230 part ii is filled but not signed. PCC should not be older than 180 days on the day of the interview. The employment letter should be notarized!

answer: This is sad! Hadn't you paid before? did you tell the consulate that you had paid?

answer: Packet 4 includes the appointment letter (most imp document) and other documents such as instructions for medicals, phoot requirements, pcc and so on. DS 230 part ii is not a part of packet 4. ds 230 part ii is what you need to carry to the interview and then sign only when the consular officer tells you to sign, not before that!

Answer: Carry documents related to your company's existence in usa and other general company journal/ manual! These are good to have documents since your employer is in india and also in usa and eventually after you get your gc you will have to come to usa within 180 days of such approval to activate and complete your gc process!

Actually When I called the consualte I mentioned about the visa fee which was already paid but they said since one year is completed I have to Repay the fee.

I got the list of documents from the link you had send.

Since I am going to the consualte alone....I have to take all the documents for me alone....I don't think I-134 is needed and other documents which are rquired for my spouse.

do you have any idea about what is the time limit after one year to submit the all the updated documents.....??? becaseu I completed one year in March 27th 2004...

I dont think there are any additional documents you need to carry other than the ones from the list. Just be ready to explain to the consular officer as to it took you 1+ year to attend the interview.

Any idea about what is the time limit to go to the consulate for submitting all the documents even after one year.......becasue for March 27th 2004 completed one year. I may be going in April 2004 but any time limit to go.....???

* Contact the consulate and inform them in advance that only you would wish to attend the interview

* After your successful interview whenever you wish apply for your wife's visa interview so that she can attend it and once she is approved she will need to fly into usa within 180 days of approval. She will need to carry all documents same as yours plus I-134 notarized and sicne your immigrant visa wuld be approved by then copies of your passport with i-551 stamp and/ or copy of you GC.

* Advise you to ask the consulate about the exact procedure since what i give you is a trailer!

I sent an email to consulate about my spouse interview....saying that my spouse will attend the interview may be after a year because of reasons. they replied for my email like this.

We can process your spouse's visa after a year, but she will be
required to
pay fees, obtain medical certificates, do medical tests and will
require
updated documents.

as you said again I have to produce I-134 to support her.

I think I can go to the consulate with all the updated documents me alone in April or May 2004. but any time limit for this.

You need to check with the consulate if you can have a walk-in interview...i doubt it!!

I am under the impression that walk-in is possible:

1. If during your scheduled interview you forgot to carry some papers and were asked to get it any other day OR

2. if you had scheduled interview and you requested the consular officer that you would any other day of that month

Actually When I sent an email about the oppoint to go to the consualte.

They replied me back that I can walk in any time between Tuesday to Friday with the refusal letter. so I don't need any oppointment letter again.

when I attended the interview one year ago consular officer also said that I can walk in any time between those days with the refusal letter... my visa got refused becasue of lack of documents to convince him. So I am carrying now.

I have one more question regarding Tax returns.

one of the document consular officer asked me to bring was
State and Federal tax returns for three years.... actually I filed thru all the years thru Tax consulatants like H &R block in USA. can I carry the same....or Do I need to get it from IRS. Please let me know.

You can carry hand-filled tax return forms for last 3 tax years and it should be fine.

Or if you have time there is no harm requesting tax transcripts from IRS also (but with tax documents that you have IRS transcripts may not be required assuming they are complete).

I have Tax returns transcripts for the previous year.

I am planning to file a tax now for the year 2003 thru online like Tax act or Turbo tax. If I file thru online and I can take a print of tax file and I can produce the same....????

since right now I am India working with same employer how can I requtest tax returns transcripts from IRS in USA??? any Idea.


Also I have one more question regarding the validity of submitting requested documents after one year of my CP. ??
any Idea what is the last day of submitting my documents after one year of CP??

Answer: YEs.

Answer: ASsuming you have field USA tax returns in last 3 years, you can request usa tax transcripts by calling IRS @ 001-800-829-1040 in usa and requesting them to mail it to you in india or by having them mail it to your friend in usa and have him mail it to you.

Answer: Not sure which documents you are thinking about. Please be more explicit!! PCC has a validity of 180 days, I-134 and Employment letters do not have a validity period but are recommended to be written up about 30 days or less prior to the interview just to make it seem reasonable as opposed to having them 1 year old. If you are thinking of other documents write back!!!

Today I am filing USA tax for 2003 thru online from India both for Federal and State.

I have one doubt in that. While filing it is asking the residence adress.....Actually since I am staying India right now can I give the India residence adress or do I need to give a residence adress in USA.......

Since I am in India...I gave my friend adress in USA to send all my posts like bank statements and Car Insurance......

so I am getting confused with giving residence while filing.

Since I am inida is it a good idea to give the Indian adress or
is it must to give usa adress......If I give India residence adress does it effect my returns from federal and state. any Idea.

Where u the resident (or had income) of US in the year 2003?I mean if you were in india for this year,then there is no requirement to file a return.
