You really dont know what this new company is up to. So, you might want to cross your fingers and sit tight.
In case you get lucky in the job, your attorney just need to send a letter to ATL DOL about the take over. Hope your job profile does not change with the sale. Also, you will need to apply for something like H1 amendment to reflect this new company name on your H1b.
Actually, the same thing happened with me... after merger, they told me that they will lay me off this month end. So I will lose my GC process with the job. GC pending at ATL for Fed clearance. Now I am searching for a new job where I can restart my GC again. My 6 years will be up in March 2004.
When I talked to my attorney he said I can get 7th year extension based on 365 days GC LC pending, with any new company even if my old company cancels my GC process altogether.
Attorney says we can get 7th year extension because my first GC process was started in good faith and was approvable at the time of application.

Thanks for ur input. Well My situation is different, Iam alerady on the 7th yr extension !!!! with this current company. My H1b 6yrs have got expired this year in March 2003. But if this Take over takes place, New GC should be started right??? If yes... Iam out of option (s) as my H1B 6 yrs expired, and even though the present company did apply for my GC 1 yr prior to the expiry of the Current H1B, I am OK with this company.... But I do not know whether they can transfer my LC to this new company who ever takes over???? iam confused and really afraid maan.....
 
When this sale happens, the new company should say something like "we bought all assets, liabilities and LCA (that goes with your H1b) from your old company" then you should be fine with your GC process. Your GC attorney should get a letter from this new company that states something like what I put in double quotes and submit to ATL DOL and all done. No need for new GC. Your attorney should be able to prove to DOL that nothing but just the company named (after take over) has changed in your case, you know what I mean.

In the other bad case, I think (I am not a legal expert), you should be able to keep getting 1 year extensions even with a totally new employer provided you start your GC new with that company.

New Situation for Whizz Kids

MY company is planning to change lawyers. As part of the process there will be 2 letters sent to the DOL in support of the change.
1. Current Lawyer will send a letter stating that they do not represent me anymore.
2. New lawyer will send a G28 showing that they are representing me now.

My DOL RD is Jan 13 2003. When I am this "CLOSE" to Labor processing, what are the risks I run because of the potential attorney change?

Is is better to remain with the current attorney till labor processing is complete and then Move for the later stages?

Please reply ASAP as the change will happen (or not) in the next 2 days.

It is always preffered to stick with same attorney during the GC process. If your company is ready to pay to old attorney or you are handling expnses from ur own pocket, then better stick with old attorney.

This is just my personal opinion, so do whatever suits you.
 
Do you guys care to know that....

Now we will have to apply for Labor Certfication even to wrok in India? India is developing so fast that theyc ame up with tis idea......

just curious

I wonder what average per application processing time at ATL DOL is (assuming the application is complete and requires no queries).. ?

How many people are involved in clearing the applications there in that office ?

And some times I also wonder if the managers there in those offices understand the psychological/cultural/social/financial stuff goes on with the applicants ?
 
The flawed system!!!

I have worked in the public sector before and was somewhat subjected to review applications of the masses who wants to provide service to the government. Yes, like it or not I was on the other side of the fence subjected to a whole lot of criticism because we are not working fast enough or too critical in our analysis of the application. Funny how the roles are now reversed. In reviewing the ATL DOL's work system, I can only assume. I have my doubts that certifying officers are assigned to the various states under their jurisdictions. I am thinking that certifying officers are dispensed cases at random according to case numbers and whatever responses that comes in due to RFE or NOE. Again we have to deal with some officers being slower than others and again some cases are more complicated than the rests. Having said this all, it is a waste of time to speculate. However, instead of trying to visualize how they work, I wish they can give us a time-frame guarantee instead, in specifying that the review of labor apps should not take more than a year or a reasonable frame of time, given resources availabilty, workforce etc. etc. This would be more fair instead of saying all review depends on the number of applications/workload that they face. Now who wants to pursue this? We just have to wait and suffer in silence- :eek:

I have been a silent watcher for last few months and I feel sorry about that.

Question: My Florida state labor got approved on Dec 20th, 2002 and Florida SESA 's website showes that case was transmitted to ATL DOL on Dec 20th, 2002. But, when I enter my case number on AVM (ATL DOL), it states that case received on Jan 30th, 2003.
Does it take month and half to reach case from FL to ATL. Is this normal? Any same experiences?

Again, it feels real satisfactory to join this group.

Now everyone's waiting for prosix's approval as he is first in line(hopefully if they process in order).... should be any moment now ... how many times did you check today prosix ?
