Atlanta (ADO) Interview Today -- No Stamping.

I am Happy to report to you that over the weekend we rec'd the Welcome Notice for my wife.
The Welcome Notice states that she should be recieving her card within 3 weeks and that will be valid for 10 yrs.
I am slightly confused there since for the card,they didn't take her pics.
In my case, I had rec'd the approval notice, after which I went for Passport stamping during when I submitted my pics &
gave up all my EADs & Advance Parole Documents.
Is the process now different or is it different for People who get approved after Interview? George, I remeber you had rec'd welcome notice. Can you tell me if this sounds right?

I got approved and stamped at the interview. In your wife's case, since she had to wait after the interview, the procedure might be a little different, I don't know...

Dear all:

few basic questions

Does all cases go to local office or some selected one? If your case is transferred then does it mean it reqires interview?

Do all people have to go to local office any way for oath or passport stamp? or do BCIS send directly approval notice and green card by mail?

Poon, you mentioned that at the local office they asked for w2, tax retruns birth certificate. But in general you would have already provided these things along wtih your I-485 application. Why they need them again?

Answer: No all cases do not get TRX to local offices. Only certain cases are chosen to be TRX. I have heard that if the likelihood if a TRX increases if the applicant has a police record, has switched jobs using AC-21. Sometimes newly married couples are also TRX. Then again a lot of cases get TRX for no apparent reason. The good news is that only a small portion of cases get TRX to local offices.

Answer: The approval notice is sent directly to the applicant. Once the applicant receives the approval notice, he/she is supposed to go to some office (not sure if its the local immigration office) to get the PP stamped. The GC is mailed to the applicant anywhere between a week to a few months.

Why do they need docs again?

I answered this question to your PM. Anyways, they want to get a status check in your own words on the day of interview, which in all probability will be the date of approval as well. Therefore, they need docs like EVL, pay-stubs etc. to make sure that you are in status and can be approved without any liability on the date of interview. If you do not have those important core docs for submittal at the time of interview, those would constitute valid grounds for denial.

You must receive your interview call anytime now. Atlanta ( ADO ) goes by the receipt date and not by transfer date. Your RD is June 2002. Currently, ADO is officially processing November 2003 cases (even though the website still says October 2003 cases). Unofficially, it is reliably learnt that they are processing February 2004 and March 2004 cases. Therefore, you must be hearing from ADO very soon. Else, you would do yourself a big favor by seeking an Infopass appointment to see what is going on.

It is already one month since your file was transferred and it is perfectly normal because it takes close to a month for ADO to receive the files transferred from the Service Center.
 
Interview

My heartierst congratulations.

My daughter was interviewed yesterday (9/29/05). Interview went well. She got the finger print and then said that Visa numbers are not available.

Our PD is March, 2001. EB-3.

Any idea how much time it will take. My guess is that the queue should move fast because there should not be many cases left over between 1998 to 2001.

Any comments.

Thanks dude. It is unfortunate that they gave you the same excuse as well. I don't know the basis for such a rumor that all the September visa numbers have gone depleted. It is not just ADO, but many district offices seem to have believed into this kind of erroneous information. I am sorry to hear that. Anyway, yeah, you may be right, but am not sure about EB-3, where the situation is still not that rosy. It is in 1st January 1998 and the pace at which EB-3 will move is anybody's guess. Also, when I spoke with the officer after getting my approval he was indicating the same fear I was having. He quipped that whenever retrogression shows up, there is a very good possibility that dates may retrogress further as many other offices report more backlogs. I hope it is not true this time around and the rock-bottom date would have been reached with the current retrogressed dates. So, let's see. We need to see that dates don't retrogress any further.

That much said, I have some of my friends working for some of the most influential companies here in the US and they said that already their HR departments have indicated to them to be not cowed down by these recent pronouncements of the State Department's visa bulletin as they are getting ready for a strong lobbying to retain the international workforce, which otherwise would undermine the US interests with its large-scale migration to European Union, India, and China. So there are hopes that things would not be this bad, come January 2006.
 
VSC to ATL to VSC to ATL again

Months passed after the interview. We were waiting for pending name check. Finally, our local congressman office informed us, our name check was cleared. But, we have to wait for visa # due to retrogression. I called 1-800-375-5283 on 11/28/05. The lady took all my info and she said VSC will send me a letter about the status of our application. Today LUDs changed.

The content of the message did not change on mine.

please help me what they going to asked me in interview

  1. Atlanta District Office ( ADO ) goes by the receipt date and not transfer date. So, it may take another month or two for them to call you for interview.
  2. Now, that may change if they are cognizant of your EB3 category if it is not current. If it is current, then they may call you soon -- because usually ADO's posted dates on the website are conservative. Realistically they are always 3-4 months ahead of the posted dates. So, you can reasonably assume that they are looking at cases between April 2005 and July 2005 now. Since you fall in this category, you may be called anytime AFTER YOUR FILE IS RECEIVED AT ADO. Usually, after transfer, it takes about 30 days for ADO to get your files. From there, it may take a little while if they want other files from their main files center.

It depends. If your case is straightforward, they will ask the standard stuff from a boilerplate. It lists all the documents you need to bring. Since yours is employment based, it starts with all your 3-year IT Tax returns, your employment verification letter, salary stubs, birth-certificate, copy of medicals, if you have your spouse then all her details including your marriage certificate, your company's financial documents etc.

If yours is transferred for any possible "negative factor" then you may have a clue in any pointed docs they may ask. In any case, if you have a separation, divorce, brush with law, etc. then have the court papers ready too.
