Hi folks,

I've applied gc in EB3 category india priority date march 2003. I dont have a valid H1 stamp in my passport. However i'm maintaining my H1 status and still working with same employer who filed my GC and i also have valid I797 H1b approval notice until end of 2006.I've advance parole valid until end of 2006.

I'm present in India and travelling back to usa within a week using my Advance parole.I've the following questions.

(1) I don't have EAD and i'm planning to work on my H1 visa only after entering usa.At POE what should I give the officer besides my passport? Only my advance parole ? or should i also give my I797 to him?

(2)I was in india for around 3 months or so. I was also working remotely from India most of the time. I want my comeback to usa as smooth as possible. company with whom i'm employed has branches also in India.At POE if by any chance they ask me about my long stay in India ..what should be the better answer?

-i stayed more because i had to do some work for comapny in India?

OR

- I had to stay for family issues. take care of parents, family and stuff.

what should be the better answer?

==> Passport and Advance Parole is sufficient. Do not give extra unless they ask for.

==> Usualy they ask "how long" not "why". However you may tell about company work if you have documents to prove that.

I had the same situations, I had valid H1 But didn't had H1 stamp in passport. I use My AP to reenter US. They didn't ask any single questions about H1.
Officer at EWR was nice.
It was pleaent experience!!!
Good Luck....BTW Keep the Photocopy of AP , CROOK OFFICER at Indian airport will ask for original AP( they want to keep with them). Give them Photocopy......
