Asylum in Los Angeles

I needed few suggestions regarding the process. I came to the US back in 2008 in student visa with the fear of persecution. I returned back in 2009 dec for a visit and was beaten badly which needed a surgery because of my involvement with a political group. So, I again came back to the US in 2010 summer. My family is still receiving threats in form of letters and visits from the vigilantes. I had no option to go back and just tried to focus in my studies. I graduated and am in opt right now. I had no idea about asylum until my friend's dad(lawyer) told me about itSo, I moved from wisconsin to Los angeles for this process since my uncle lives here. So, can anyone tell me how are the chances specially I will be filing it after more than 2 years. I have all the reports from doctor and police. I wish I had enquired about the asylum but got too occupied with my studies. My country of persecution is Nepal.

you can apply for asylum but you will have to proof why it took you so long to apply because the normal date line is 1year but you can still apply even after 1year if the condition of the country changed.
 
In dire need of help

I came to us last year on November on visitor visa , applied for assylum in April and interviewed 29 may.
The decision is still pending and the officer was so mean to me that day , I had lots of ups and downs for the past6 months I went to withdraw my case . A day after that I canceled my withdrawal and came to Chicago . I faxed th office wrote them a letter and asked about my status but there is not a single answer. I do not know what to do please help me . I speak English so in interview I had no interpreter or lawyer . How can I be informed that they did not reject my case .

why did you withdaw your case?
if you are out of status i think its going to be bad because you have withdrawn your case but i think you can reapply but to be honest they will think you are lying even if your story is the truth apart if you convince the offcier why you withdraw the case.Best wishes
 
I was wondering if there will be a delay for result for a student like me in OPT?
Also, after I apply for asylum, will my opt expire or what will happen?
If there is a delay like I am reading here, do I just have to wait or use my current work permit to work in my field?
I also read that the decision doesn't go to court and I will simply be back in my F1 status. Is it correcT?

if you are in status ,you will not go to court but i don't understand if you really indeed withdraw your application by calling or by filling the withdraw form.what did you do because i also don't understand how you say the office did not withdraw your application if you ask it to be withdrawn ,it doesnt make a lot of sense
 
I will be applying in mid November. I am hearing rumours that its hard to win a case if its almost end of the year because they have a quota or something. Any truth in that?

I went to the office to withdraw because my mom went to coma back home, i withdrew my case and one day after that I went there and aske for voiding the withdrawal . I'm out of status cause I had only 6 month visitor visa . But they did not answer me yet.

Am so sorry to hear that ,i will pray for your mom.So what did you or are you planning to do?because i honestly did not understand what you talking abouy because its kind of confusing

I appreciate your sympathy , my father died before I came to us and my mother means a lot to me thats why when I heard her voice in hospital I forgot all my plans and all.
I don't know how to be informed about my case I'm sending a friend next week to losangeles asylum to ask about my status. Because I honestly donot know what is my status whether they rejected my case or not , cause the day I asked for my cancelling I came to Chicago to my sister's house. I faxed them and asked about my status , I wrote a mail to asylum in Los Angeles . But I do not have the answer yet . And I don't know whether they rejected me or not, but seriously if they rejectedted me they shoud have sent a letter to my address or not. I was at my uncle's house in Los Angeles and If they sent me letters even to them they shoudl have had it there too , correct me if I'm wrong? But how is the process of rejecting or how should I know whether I am rejected or not.

Well i see what you talking about now, what i think is that you will just have to wait and see or send your friend but am sure they will not release any information to your friend simply because they cannot share such confidential information.What you can may be do is to go to the uscis website and find the requirements needed by someone to let someone else get information about his case.Also let me point out something very important is that am not really sure if they will continue processing your case because in the laws to apply for asylum ,an asylum applicant before travelling out of the country must get a refugee travelling document which can let you come back to the country.Becasue if you just suddenly go, they will consider that you abandoned your case and they will reject it.Also the mistake you did is that you sent a letter of withdrawal and if it falls into the right hands,they will immediately drop the case and am not sure you can appeal for that.Also,i am very afraid to renter the country will not be easy for you because even if you apply for a different visa,they have all your records in file and they will probably give you a lot of trouble but i don't mean its impossible to re-enter.But if in case you enter and your asylum was not canceled,just let them know you went bak again because of an emergency and explain them what happened and i will also advice you to have proofs like bills and all stuffs that can proof what you are saying.Also a main problem is that they will surely ask you why did you go back to your country of persecution.I guess you have to explain them all you are telling me now with alot of prooofs.All i can really tell you is that if by God grace you can re-enter just try an hire an immigration attorney because to be honest with you ,you case is very complicated that what you think.Just first pray that you re-enter in the USA that is the first step before trying to talk of your case.May the soul of your dad rest in perfect peace.I hope things will go well for you.

And the day before I came to Chicago I went to asylum office in Los Angeles and cancelled my withdrawal and the same day without more I came to Chicago in the asylum that asked me to sign the letter and asked them to void the withdrawal.therfore I did it and came here in Chicago and got locked up .sorry that I confused you with lots of details right now it's been 6 months since I interviewed . I'm sending my uncle in LA with my friend as a translator and my uncle has a letter with my Anumber on it.

you welcome,well its a good news that you did not live the country.What i will advice you to do is to call the 800 number on uscis.gov website and ask them what is going on with your case and if the customer says you go to your local asylum office and since you are no more in los angeles for the moment ,i will also advice you to contact the office where you went for the interview and ask them about your case.But i probably think they won't say something because they don't really release informations on the phone other than that you reserve an info pass to go an see an immigration officer.But atleast try to call them and you say that you want to know about your case and that you are out of state ,they will probably ask for your receipt number and allien number(A-number) but if they say they cannot release that on the phone ,you can then ask them how you can send someone to get than and i am sure they will tell you to give a written notification for the release of such information to your uncle ,that's why you need to ask them about that (if there is anywhere you can write a letter with your signature authorizing the release of the info to your uncle.Right now ,i will advice you to make a lot of effort to contact the asylum office where you went to withdraw your case and know if they have indeed withdrawn it and if yes ,then ask if you can appeal back for the case to be reconsidered ,if yes then good deal ,if no then ask if there is any alternative way.Best regards
