asylum decision, when and how?

my bro applied for asylum on his first ever visit to US and got 6 months visa at airport and applied for asylum after 2 months of entry. he came in SEP 2007 and has visa till march of 2008, and he applied for asylum in begining of NOV 2007 and had his interview on DEC,04 2007. after the interview, the officer gave him a letter in which it says his decision would be mailed but gave no time table when.

it's been just over 2 months now that he hasn't received his decision and his B-2 visa is expiring in mid March of 2008. in January 2007, after one month of interview, we sent an asylum status inquiry letter to the asylum office and they replied back to him with a letter of pre typed responses to asylum status inquiry. the one that was checked was their answer and it was, your case is pending in this asylum office and you will be notified of any decision something. so it seemed like it wasn't due to security check issue
as that answer wasn't checked.

we sent a second letter in feb, 04, 2008, requesting for an update on his asylum decision and we expect to get a response in few days, but mostly, it wil be same letter that is your case is pending on this office.

we just don't know when my bro will get decision, after his visa expires in marh 2008 or before or after few years?

its been over 60 days and no decision from AO office.

If security/background check is pending there is nothing it can be done to expedite that, but just wait. People wait for months and even years, so your brother's case is not unique. I know its a pain, but the current law prohibits them to make a decision without the security check cleared.

No matter how many letter inquiring about it you sent, if background still pending you will receive the same letter.

His B visa status DOENST HAVE ANYTHING to do with the decision of the asylum or his background check. Is not like CIS is waiting for your brother's B visa to expire for them to give a decision...

As soon as the security check is clear he will receive a decision, it can be BEFORE or AFTER march 2008.

Even if his current status expires, he still will be in "pending asylum status" therefore, a legal status to remain in the US.

my bro's asylum interview was on dec,04 2007 and till now no decision came in mail. they gave my bro a peice of paper that says his decision would be mailed but didn't indicate when.meanwhile, my bro's b2 visa is expiring in march 2008.

we did sent first letter of asylum status inquiry to AO office in Jan 2008 and that time they have said this which was check marked as their reply to our inquiry, by the way, thier response is pre printed and have many answers to asylum status inquiry, the answer that was checked was--YOUR APPLICATION IS PENDING IN THIS OFFICE. U WILL BE NOTIFIED BY MAIL OF ANY DEICISIONS RELATING TO YOUR CASE. U NEED TO NOTIFY US OF ANY CHANGE OF ADDRESS TO PREVENT DELAYS IN RECEIVING FURTHER NOTIFICATIONS REGARDING YOUR YOUR CASE.

We sent another letter of asylum status inquiry saying it's been over 60 days since the interview and we are asking for update on decision.

We received same pre answered, pre typed reply letter from AO office and it has a check marked one answer that says--

WE ARE ACTIVELY PROCESSING THIS CASE. HOWEVER, WE HAVE TO PERFORM ADDITIONAL REVIEW ON THIS CASE AND THIS HAS CAUSED A LONGER PROCESSING TIME. IF YOU DON'T RECEIVE A DECISION OR OTHER NOTICE OF ACTION FROM US WITHIN 6 MONTHS OF THIS INQUIRY RESPONSE, PLEASE CONTACT THIS OFFICE AGAIN VIA MAIL.

Now from my experince in asylum cases with asylum office, I have never seen such a delays in deciding asylum case, there are delays in court hearings but with asylum office, decision, yes or no are issued within 2 weeks or 10 days. I myself got rejection letter at AO within 2 weeks and same goes to my sister and 7 other people i know who are all asylees from same country. many of thier cases happened between 2003 and 2006, none of them have faced delays of months from asylum office.

This is very strange to my knowledge. some say decision for in current legal status takes months or issued only after thier visa status expires, but some of those i know applied for asylum when they had about 2 or 3 months b2 visa left and never faces delays. i wanted to ask an expereinced immigration lawyer about this delays and why such delays and what might be the decision, but then will be paying fees to ask those.
anyway, it's so bad and so strange.
obviously, it seems like thier delays in sending decision letter is not due to security checks as that answer is not checked.
 
Jonny1 did your brother got his decision? This is interesting to me because I am going through a similar circumstances

I doubt you will get an answer. Relax and wait. Nothing you can do right now as they say the universe unfolds as it should. My case has been pending for 21 months now after interview.
 
Dear Experience Holder of Political Asylum!
Please let me know if person apply for Asylum in USA on B1 Visa or B2 Visa then is they detain you like any detention center or just we need to meet lawyers and case start to send letter and interview since my cousin have fear to apply for this as he have a Business Visa and he travel to USA 2 time but still he have fear to apply that case, please confirm in details, how to apply, its from Pakistan, is they accept Pakistani passport for asylum.
 
Dear ASIF SHAIKH, I must begin by telling you that I have no expertise in this matter, my knowledge comes from my own experience and the information provided by the USCIS itself. Having said that I can tell you this:
Tell your cousin hat he can apply no matter the type of visa he has or even his status (is better if he has a valid status), he won't be detained and he doesn't need a lawyer to file an application. Some people would feel more comfortable using a lawyer other will advice you against it. It's his call.
Finally it doesn't matter his nationality as long as he can proof that he was persecuted in his country.
