Asylum claim and Fraud charges

Nice...

Hi Greencarder,

Your situation is really difficult, but do not lost faith. Just go there very positive and calm. You are working for an american company, you have paid taxes. Just believe. Good luck, Cl.:)

Cl_asylee,
I know you are just trying to cheer the poor guy but paying taxes and working for a US company abroad is not good enough reason to excuse him from the continuos residency rule unless he has filed the form to preserve his residency which he obviously hasn't done. Paying taxes is just another requirement clearly mentioned on the citizenship application which is mutually exclusive from residency requirement but equally important. Even if he wasn't asylee and he went to his country of birth and lives there beyond the time frame allowed, his PR status would be assumed to have been abandoned. It is called "Permanent Residence" for a reason. Giving you a GC or LPR status is stipulated with the condition that you'll make US as your permanent home.
Greencarder, clearly doesn't fulfill the residency requirement here. The best thing he can do is come back to US if he wants to be a USC one day. If he loves his job in his COP better then he would have to make choice and say bye bye to his dream of becoming a USC. After coming back to US, withdraw his N-400 application, find a job and start working towards accumulating the time period required to file for naturaliztion and then re-file. I don't see a short cut here.
This is what I would do if I was in his shoes unless someone can give you a better advice.

You are right. He already applied, he might go and see what happens.

but...

If he withdraws his application, it will be different than getting denied. Once he gets denied and re-files, then N400 specifically asks if you have denied before? Which can lead Officer to look into the same mess that he is in right now. By withdrawing his application, there is a chance that he can re-establish his credibility (residency requirement) and apply when he has spotless previous five years and there is a good chance his application might go through smoothly if he runs into an officer who is not very anal.
