One year GC Backdating Evidence

Hi All,

I'm filing form N-470, application to preserve permanent residence for naturalization purpose. I got approved last month and haven't yet received the green card. I need to file the form before leaving the US next week. But the form says that you have to reside in and be physically present in the US for an uninterrupted period of one year, after becoming lawful residence, to be eligible for approval.

Even thought I was approved in March 2006, I would be considered a permanent residence since March 2005. I need to send them some evidence with the application, as I just called the customer center and they told me that it was not true!

Does anyone know a link to an USCIS site that indicates that asylum-based green card are back-dated one year?

Do not bother calling the 800 number. You are not going to learn anything meaningful most of the time.

Your best bet is to enclose a copy of section 209(b) of the INA.
