Hello, could somebody point me in the right direction as to what constitutes a "safe country" today from the US immigration law's point of view? There are new new rules coming into force from 11th May this year. I.e. Title 42 will be retired and replaced by Title 8. The below is an extract from T8, and it is a cause for concern for those individuals seeking entry to the US through the southern border via Mexico. My own relative is one of those people and I really want to help him. Apologies for the messed up formatting - couldn't get rid of the bold font. And sorry if this has already been discussed, but my searches weren't successful.
Bars to Applying for Asylum
You may not be eligible to apply for asylum if you:- Did not comply with the 1-year filing deadline for filing an application for asylum within 1 year of your last arrival in the United States or April 1, 1997, whichever is later;
- Had a previous asylum application denied by an immigration judge or the Board of Immigration Appeals; or
- Can be removed to a safe third country under a 2-party or multi-party agreement between the United States and other countries.
