Asylum Application refered to Immigration court

Hi All,

I had my interview at Asylum office last wekk - I thought it went OK - I went to pick up the results today - The case has been referred to the court - the hearing is in 2 weeks.

Does this mean that my application success is tough now ?

Does anyone know about this court referral process - like how long it takes, how many hearings usually happen etc.etc ?

Does this usually happen or is it a rare case of refering to the court ?

I am praying and hopeful - Thanks all...
 
This is not an unusual outcome. I and many others here have had their asylum granted through Immigration court. Take it as a second chance to present your case all over again. My case in New York City took exactly one year from start to finish. I had four court appearance. The first appearance , the Judge gave us our options and asked what we wanted to do. Second appearance, we submitted all our documents and evidence, third appearance was the individual interview and the last appearance was the decision.
 
Thats normal! now after 2 week judge will give you another date that could be a year longer. it depends on judge's schedule.

Do you guys know whether we can submit all the paperwork fresh again to the Immigration court ? OR is it that the Asylum office sends the application packet with all the documents directly to the court ?

I have gathered few extra details and additions to support my case, based on the response I got from the Asylum office...so will I get a chance to submit all the new/revised paperworks and statements to the court, when I go for the initial hearing??

The Immigration Court and USCIS are two separate entities. Like how you have to convince your case to the Judge, the attorney representing USCIS also has to convince the Judge their case. Your case starts anew. Take all the time the Judge gives you. If you need additional time, just ask the Judge for it. Just remember, if you ask for additional time, your clock will stop and that could cause a problem in getting EAD.

I lost my job last month and hence I am in a state of being out of status - so seems like I am getting dates for each of the proceedings with my asylum case fast.

My attorney was saying that after my first hearing on 24th (Master hearing) - I might get a sooner date - but my Attorney seems to be busy till Nov 2nd - so she was planning to push over my next hearing to after Nov 2nd week - so that she gets time to prepare.

Hope everything ends up positives,,...I am worried...godd !!
