Hello,

I am ready to apply for asylum with the help of a law student. I know I cannot get EAD until it is approved or 150 days later. I am now on F1,already used OPT and taking one more course this year. I just got an offer for a two-year research position. They only sponsor J. The position starts at the end of January.
Can I apply for asylum and then apply to change status to J?Will they interview me about intention to go back?
Is it better to apply for J and then asylum?J application required me to discuss how my circumstances changed (F1 to J)?How can I do that so that it does not jeopardize my asylum application?

The law student says since I have been in the country for more than 1 year, the more I wait, the harder it will be to urge for the exception to the rule. Another lawyer said the 1-year rule does not apply as long as you are in status.

Please help! Since my OPT expired, I am surviving with borrowed money. It took several months to put the documents together since I have to work with free legal help. I do not want to miss this 2-year job opportunity because it will also be very good for my career.

You'd better consult a lawyer regarding the change of status. As far as I know, J doesn't allow you to have any immigration intent to the U.S. If you apply for asylum first and then apply for J, how to demonstrate that you will return to your home country in the future?

Regarding the 1 year rule, as long as you are in status, you can apply for asylum at any time.
