Hello.
I have a ? and 'd appreciate if someone can help me with it.
If we get granted an asylee status can we later apply for H and GC through it or straight to GC sponsored by university or other employer? Or if one gets asylle he/she cannot apply for any non-immig status anymore (at least while one keeps asylee status) and GC through it, which basically mean you're stuck with it till you're granted GC in 10....20 years  ?

Thank you

I do not know how you got the information, but an H visa (or any other nonimmigrant visa) has ABSOLUTELY NOTHING to do with the employment-based immigration process. A nonimmigrant status does not lead to any green cards.

Repeat, all H visas do is to allow an otherwise ineligible person to work in the United States for a specific employer for a limited period of time. They have nothing nothing to do with the green card process.

wait a minute...

I have a bunch of friends who had H visas and then their employers submitted for their GCs...however, Alex G, this is a tricky and complicated process - and at any rate, if you are doing any parallel things, get a really good attorneya nd double check and triple check your information.

Good luck!

Your asylum status gives your permission to work for anybody you wish. You do not need a H visa or any other visas. You can go straight to the labor certification stage.

But things can get complicated because you already applied for asylum. So you should hire counsel for this.

yep

Thanks,
i know that H doesn't give you GC, but it's a legitimate way of getting it. Another way you can do directly GC if you're doing important research and can be classified as an outstanding researcher (we probably can), hard but not impossible. Anybody knows if we can get (employer) H -> GC or GC (outstanding) while having a asylee status? Since getting GC as an asylee now may take 10-20 years with current backload of the applications it could be faster alternative, but I don't know if it's doable. I am trying to get consultations from attorneys and just thought that anyone or their friends might have had some experience with similar situation.
Thank you
