HI GUYS ..I HAVE REALLY DIFFERENT SITUATION THEN ANYONE ELSE...I TRIED TO FIND OUT ANSWER FOR MY QUESTIONS BUT I DIDNT GEY ANY AT ALL BUT I APPERICIATE ALL THE HELP PEOPLE TRY TO GIVE ME THOUGH....
SO I WAS THINKING ABOUT I WANT TO START A THREAD OR FORUM WHICH CAN BE FOR THOSE WHO ENTRED IN USA AS AN EWI(ENTRY WITHOUT INSPECTION) OR ILLEGALY AND THEN THEY APPLY FOR ASYLUM AND THERE CASE IN REMOVAL PROCEEDINGS ..AND ON THE OTHER HAND WHO R MARRIED TOO AND GOT THERE I-130 APPROVED OR OTHER PETITIONS APPROVED LIKE I-824 OR I-864 OR DS-230 PART 1 OR SO.. WHO R HAVING TWO CASE RUNNING PARALLEL... ASYLEE REMOVAL PROCEEDINGS AND MARRIGE TO USC AND THERE CASE IN NVC..I KNOW IT SOUND TOO COMLICATED BUT IT MORE THAN THAT WHEN U HAVE NO HELP AND NOM ONEY TO HIRE A NICE LAWYER..CANY ANY WANT HELP OR START A THREAD

First of all if you entered and stayed illegally in US for more than 6 months or a 1 year, it will trigger an automatic ban of either 3 years or 10 years if you leave US for a immigrant Visa interview even if you are married to a USC. So write to NVC that as you are in US and like to adjust your status here itself. Secondly you may be able to get a relief from removal proceeding by presenting to immigration judge the fact that you are married to a USC. Your case is very complicated I will suggest to hire an Attorny. Lot of catholic charities help in immigration cases. They have competent Attorney's who help them. Find a charity in your Area and ask for help.

I agree with your advice about her getting some legal services - Catholic Charities or pro bono through the local bar association would be fine if she can't afford a private attorney.

However, as for you legal analysis and suggestions above, I am not sure how you were able to answer her. She does not provide nearly enough facts for me to even start guessing as to what she should do. She would need to provide a lot more information before one could even make a prediction.

She needs to go for a one-on-one consultation, as I have indicated in the other string. I do hope she will take the advice seriously.
 
I Really Dont Have No Option

YES I DID ENTRED ILLEGALLY IN USA BUT RIGHT AFTER I APPLIED FOR MY ASYLUM MAY BE IN ONE MONTH.AND OTHER THAN THAT I CAN NOT ADJUST MY STATUS IN USA AS PER THE BEST OF MY KNOWELDGE FROM ALL SOURCES AND GOOD LAWYERS AS WELL AS USCIS,INFOPASS AND NVC ..EACH AND EVRYONE TOLD ME THAT I HAVE TO LEAVE THE COUNTRY AND GET VISA FROM THE COUNTRY OF MY ORIGIN AND COME BACK SO IN THAT WAY I WILL BE LEGALLY ENTERING IN THE USA. SO EITHER WAY REMOVAL PROCEDDINGS AND INDIVIDUAL HEARING DATE AND ..... IF NVC APPROVE MY I-864 AND DS230 PART 1 I HAVE TO LEAVE THE COUNTRY.
WELL I TALK TO SO MANY PPL AND LAWYERS...AND I EVEN TALK TO Catholic Charities or pro bono through the local bar association . I GUESS I TALK AT LEAST 5 (FIVE) OF THEM AND MOST OF THEM R SAYING WE DONT HANDLE THAT KIND OF CASES AND THEY R SAYING IT IS TOO COMPLICATED....WELL I KNOW IT IS COMPLICATED.
RIGHT NOW I AM THINKING ABOUT GETING VOLUNTRY DEPARTURE AND BY THE MEAN TIME MAY BE MY I-864 AND DS -230 WILL BE APPROVED.AND MAY BE AND MAY BE NOT I WILL BE ABLE TO GET VISA FROM THE COUNTRY OF MY ORIGIN THAT IS INDIA.THATS THE ONLY OPTION I LEFT WITH..I DONT EVEN HAVE ANY OPTION EVEN WHEN NVC APPROVE THE CASE THEY GONA SEND ME BACK TO INDIA,TO GET IMMIGARNT VISA FROM THE CONSULATE FROM INDIA..

I don't give anyone any legal opinions, as I am not an Attorney. By the way I was just stating the facts. and that's why I wrote If's and may be's. The fact that she enterd USA illegaly make her ineligible for immigration benefits but if she entered before Dec 2001 and applied for Asylum before 4/2001, She may qualify under section 245(i). As per removal proceeding if she tells court about her marriage it may grant or deny her request. Nothing is ever granted in this kind of case that's why I suggested her to consult an Attorney through charities. Moreover You can not make any predictions in any legal proceedings.

Wow. I really like your attitude and tact. What kind of law are you going to practice? Immigration Law?
