Arrested on May 22 and Interview date on June 18 at Oakland, CA

In my opinion, the best thing any applicant should do, in addition to honestly providing all relevant facts, is to imagine himself/herself in the position of an IO trying to evaluate the Good Moral Character of an applicant based on the information available in the file as well as in the public records. This is no legal advice, just common sense (I am an engineer too :) ).

After I/O officer took my Oath (on June 18th) before starting the interview I/O officer asked me for Driver Lic and Green card and Passport.

I gave the Driver Lic and Green Card and Said that I don't have a passport. I/O Officer asked that did you enter using somebody else passport and I said NO. I said I entered US with NO passport. After that I/O officer did not ask anything.

After recieving N-652 on Interview date on June18th due to Arrest but no charges filed - I recieved Oath date- after 17 days

7/12/2007= I had apt at USCIS at San Francisco (Infopass). Immigration officer said that your N-400 is cleared and your Oath date is on 8/7/2007 at San Francisco. I/O also gave me the N-445 confirming the Oath ceremony. ...and I came home after Infopass apt and checked my mail. There was N-445 Oath letter in the mail as well

6. Interview result = Recommended for approval and I/O gave me N-652 = 6/18/2007
6. Infopass - SanFrancisco - Got Oath date -N-445 = 7/12/2007

But I have something to share with you and the rest of you guys reading this thread:

My case is a little bit similar to rihykes:
My ex- wife filed an made a case agaisnt me for domestic issues, (2001 )so we went to cout and "ORDER OF PROTECTION WAS GIVEN ON CONSENT WITHOUT ADMISSION OF THE CHARGES", This happened during my H- 1 years , no green card yet.
However, after a couple of months she made a report to police that I violated the Order of Protection, so The cops called and invited me to the Police station and I was handcuffed and was about to be jailed after I was mugshot and fingerprinted.
Fortunately,my ex- mother in law called testifying that I did not violate the order and I heard the arresting cop was talking to DA and over the phone the cop said based on my kids and my ex- mother in law testimonies ( by phone interview) I was not guilty of the charges so i was released the same night, but there was no paper signed and i wasnt really put in jail.
On my way out, i was asking the cops for release papers, and they said theres none. ( Did that mean No case filed, no record made??)
On my GC application and approval (Sept 2004), nothing came out, and my FP was cleared so my guess was that arrest was not recorded, thats why i was cleared criminally.

Do you I should mention these during the interview or i will just mention the Order of Protection with the court document ( Disposition of By consent and NO admission of the charges) because if i will mention the alleged violation of order of protection, I DONT HAVE PAPER TO PROVE THAT I WAS NOT REALLY CHARGED OFFICIALLY.

To all GURUS, and anybody who could make a comment or give an insight I will really appreciate it.
Anyway, I am in the process of requesting a Good of moral character from NYC Police Department, to double check on this.

YES. You must mention the Arrest and Court order of protection. Please do not forget to take ORIGINALs to the Interview and you can mail COPIES with the form.

1. regarding the Order of Protection, definitely I will mention that since I have a document from the court
2. regarding the arrest I DONT HAVE ANY PAPER to rpove THAT I WAS ARRESTED AND RELEASED , even when I came back to the police precint where i was arrested, there was no report, so i was thinking, if nothing negative that comes up with my good moral certification request from New York POlice Department, i am contemplating not to mention it at all during the interview because it seems to me there was no Documentation of the arrest that happened that day.

any opinion???

#2 - You mentioned that you were fingerprinted - You can contact dept of Justice if Police is not helping you with a Record. Even if you dont get response, I would suggest you to put this arrest in the form and stating that no record is given by police and write an explaination. Also you can detail this in the interview.

See, if you have record or not it does not mean that you were not arrested.

That is my 2 cents, you can certainly contact different lawyer for more legal advice.

6/18/2007= I had my interview today and went ok except I was arrested on May 22nd - 3 weeks before the interview. I/O officer asked me about arrests and I truthfully told that I was arrested for 5 hours and released and the D/A did not file any charges. I/O officer cleared for interview for "Recommended Approval". I/O officer told me that Supervisor needs to take a look at Arrest and we will send you decision in the mail.

I was very nervous about this and same thing happened. I was never arrested in US before and 3 weeks before it happened, bad day, I suppose.

Then explain in the citizenship interview/application that you were detained and released without charges in the same day, and get a supporting letter or document from the police precinct saying that they have no record of you being arrested.

something similar--so i was arrested on a failure to appear from the day of interview to the day of oath. the FTA was for a charge of code violation at my residence. I didn't show up to court. I was charged way before my interview. When i disclose this at oath will or can i be denied?

What were you charged with? FTA means you had to go to court for something else and you failed to go to court, and the Judge issued you an arrest warrant.
