Hope you can help me with this issue.I was driving, got arrested on Aug 2005 due to refusal for breath analysis test .They took me to hospital drawn blood and kept in jail for 12hrs.But they couldnt prove from my blood that I was over legal alcoholic limit.I got a ticket for refusal for chemical test. The hearing for refusal to chemical test, officer didnt show up , case dismissed and no action taken. There are no other records or anything on court.Only the record I hope will be on driving assessment and appeal division. My driving license suspended becuase of refusal.

I did travel couple times out of country after this incident ,never nobody questioned about it.Also did finger print for job and nothing found either. Is this is a driving violation?Do I have to mention this on citizenship form?

Thanks in advance for your help
Sincerely
Gince

Yes, you have to mention it as it was an arrest even if it didn't lead to conviction. You'll need to get a letter from the court indicating that there was no conviction or record of the incident.

I have a letter from driver appeal division saying case dismissed and a letter from city counselor and attorney saying they not taking any actions. Is that good?

That should be sufficient. Call the court as well to see if they can supply you with anything that states that no charges were dismissed just in case IO decided to ask for a court certified document at interview.

I contacted court 4 years before for my driving license to get a letter saying no action taken. But clerk told me there are no records on me ,so they cannot give anything who dont have any records. You still think they can give one?

Thanks a lot bobsmith

I really appreciate it
