arrested and Port of entry

I got arrested and served the term for misdemeanor crime. (It was more of discount label mischievous at retail store result of challenge with friend), which I realized now how stupid I can be to do such thing and have enormous regret for my behavior. I got my punishment also. Cops arrested and detained me for one day and next day released by my saying about charges “No Contest” since I have served the term already. Story of my blunder ends here may not be true for future implication.

My status in USA:

I am at present on H1B holder and visa is stamped on my passport till Jan, 2006 and currently working.

My real concerns are :

1) I have my flights booked to India (I am going alone not with family) in the month of November. My concern is while I return at Port Of Entry, they may denied me entry if they see my arrest entry in their system even though I have served the term and my crime was not even felony or any kind of threat. Or I should avoid going out of USA since my family will be here only? In that case how long I can avoid going out?

Pl advice what one should expect in cases like this? Whether they can hold me at airport and deport me without even letting me go to my home and to family in USA for this kind of previous crime which is already served (Other then this my record is clean)

I did send my approved visa stamping this July to ST Lu and received it back with stamping. My incident happens last week.

Did they take your finger print if yes then dont go to india ..else you may take chance ...but remember irrespective of big or small ..you've commited a crime .... act wisely .....else u can be in big S..t!!! who knows what they might do to you once you return ... i know couple of cases when they were deported from portof entry for some other reason though they had valid visa etc..... but they were on business visa ......

As You wrote you were indeed very stupid to do what u did and that black mark/police record cannot be removed ...but try to have good friends .. who will not mislead you ..but will try to help and guide you in right direction.....Good luck !!!!

I do not completely agree with what IPC302 has said. If you already have your visa extended and this incident happened afterwards, you might be ok.

It does look like you crime is that of a moral turpitude, but if this is your one and only crime, then you are ok. Check for the boards for moral turpitude and disorderly conduct for more information.

Make sure you have each and every document with you regarding your court case and you should be ok. And yes... don't do such foolish things in the future.

Its only and only one crime .But looks to me I am screwed for my rest of life.
Yes my visa extension was before this.
 
There is not enough information here to give any information with any accuracy. Were you charged, if so, with what. Did you go before a judge? Were you convicted? What was the sentence? What precisely did you do?

You need to have all of these facts ready and then speak to an attorney.

Office wanted to give only notice, but I was having out of state license/ID so he can't give me notice. He arrested me and next day I appeared in court and they released me without fine except with court cost of 240 dollars like clerk fee etc.

I appeared judge said term served I said no contest and left the place.

That’s it.

Can I earn good certificate by doing some community service or some thing else. which I can send to USICS when they review my file for I 485 for any criminal activity etc.

If yes how and where I can do it.
 
I have just received my finger print notice.It was filed in December 2003 at vermont center.

My I 140 is over due by 7 months at this center.

485 is yet to go one more years as per dates on vermont center sept 2002
 
Any one with arrest record, did they had any problem at POE when you travel outside with GC (after receiving first time)

Also at POE, do they finger print people with GC (including new LPR)?
