Arrest record decision!!! for application

I had an arrest record for a traffic ticket. It was a differnet city and i sent the check and forgot about it. However, which they never got and then i got arrested 3 yrs later in that city while they caught me speeding. they arersted me becos of old outstanding tickets.

The ticket was for expired registration tag. No moving violation. I got arrested and then was released after 8 hours when my friend paid the ticket payment.

Now, i am applying for H1B now and then later wish to apply for GC and possibly will go to Mexico for stamping if H1B gets approved.

Will there be any problem for this thing? That wasnt no felony or anything. Just not sure, what should i say on application and if i say YES then what and how should i tell them that wasnt any felony or anything big.

One more thing, does anybody know how to make a record (arrest record) NULL from the database with any procedures? like going through a time phase with no arrest record or crime. cos that was my only record ever.

Any help and suggestion will be highly appreciated!!

If you were finger printed and photographed , then your arrest record would remain in FBI database forever. If you were not finger printed , then forget the whole story , as you are fine

I am assuming you were , therfore suggesting you as per that and as per whatever I know .

The arrest records are never expunged for immigration purposes . If you were arrested then you will have to say yes in form D 156 for H1 stamping and form I485 for Green card .

When you for Visa stamping,they will again finger print you and the results will be sent by FBI to consulate . The time varies from consulate to consulate . Could be from 3 weeks to 8 weeks . So plan accordingly .

The above is as per my knowledge , but I am 99.99 % sure that it is correct .
 
Thanks for your quick reply. yeah i was fingerprinted and all those craps. but however, i have asked the officer over there and he said the record will be there but since it was a misdemenor, i can do something to expunge it in some way. that time i didt pay attention that much to do that.

Any body have any idea, how to do that? i think i need to write a letter to the county sherriff and tell about my situation and then review my crime history and take decision sometime.

Anyway, my other question now is that, even if i say YES on the paper while applying for GC or Stamping for H1, will it make it "impossible" to get GC or H1 stamp? i am OK about that the extra time frame and not worrying about that as long as this wouldnt hinder the process. Again, i will be applying based on H1 to GC and that was my only offense.

Even if you are in a position to expunge your records , they are never expunged for immigration purpose .Expungement means that records will not be availaible for Public ( Like when you do background check for a new job) .Fo law enforcement agencies , arrests records are never expunged .You may hire a crminal attorney to explore your options.

It is not impposible to get GC ( if your crime is not deportable ) . Many people have got it . Search the forum and you will get examples . one of them is http://www.immigrationportal.com/showthread.php?t=138444

Some people have got visa staming also after DUI .....

this is all what i know.
