Regardless of the effect on the green card, are we eligible or not. if you have 485 pending, does that mean you are eligible.

Thanks

you're not eligible until and unless you're a permanent resident. I don't know if you need the physical card to show at the unemployment office or the passprt stamp is enough.

however, each state has its own rules. some states only allow citizens to draw unemployment benefits. check with your sec. state office.

most states allow you to collect ui.

it is good to call the ui office tell them whether your your work authorization card is enough for getting it.

Why don't you try it.

Why don't you go to the web site of Unemployment Insurance for the state or states where you worked in for the last 24 months. If you worked for more than one state, then pick the one that gives you more. May be you will be eligible in one state and not for another state, I don't know.

Just go to the web search under "Unemployment Insurance" and call them and apply on the phone. If you don't find it, then let me know what state or states you worked in last 24 months, I will help you.

One thing: Being eligible does not mean it does not affect your green card application. So, please check with a lawyer about that.

just my own personal view

it doesn't look good if before even becoming a u.s. permanent resident, let alone a citizen, you're already extending your palm to take help from the state. I don't know if INS has any ability to check on these info or not, but my common sense tells me if they do, then it will have an adverse affect on your application since you're proving you've lost your job and have already become burden to the country.

talk to your lawyer before taking such a step.
