Are TN holder eligible for stimulus payment?

TN's are eligible for the stimulus package.

IF they filed in 2007.

Their spouse's are not unless they have an SSN.

But remember, even if you don't get a check, you will get the benefit next year at tax time.

We've all been thru this before with the 2002 dish out.

What I read is if you have a TN and an SSN, your wife has an ITIN, and you filed jointly you do NOT get the package.

So the only way you may be eligible is if you filed separately or are single.

My wife and daughter will not have an SSN next year either, how will I get the benefit next year?

Am I wrong in the above statement? Also sorry I didnt move here until 2006 so I had no idea this was done in 2002 as well.

This is correct. An accountant also told me about it.

Don't forget that the check is merely an advance on your 2008 tax refund.

So, if you don't get some or all of it now, you can still apply for it in the spring. (At least the portion that is for the person(s) with SSN.)I have a feeling that the SSN requirement will be gone by the time you file next year (this is what has happened for the Child credit, which also origianlly required SSN for the kids) and you will get all that you were entitled to.

I would not be splitting my tax return just to get this advance.

I doubt that we will receive anything as we are considered as a TN holder is considered as a NonResident Alien.

From the IRS website :
The Economic Stimulus Act of 2008, which authorized the pre-payment of this one-time credit, stipulates that the payment is not to be made to any of the following:

Individuals who can be claimed as a dependent on someone else's tax return;
Nonresident aliens; or
Anyone who does not have a valid Social Security Number.
If you become eligible during 2008, you may be able to claim the credit on your Tax Year 2008 return, but you will not receive the advance payment this year, since that is based on your 2007 return.

For more information about the Economic Stimulus Payment, please see these Frequently Asked Questions.

A TN living in US is NOT a Nonresident Alien, otherwise one would not file a 1040, but would have to file a 1040NR (students fall in this category, not TNers).

In any event, this is not a tax forum, so I invite you all to forums.serbinski.com to vent about this
