Are there any approval after 2nd FP???

My question is:
For cases with 2nd FP issued/completed before a RFE was issued, are there any approvals or RFE's generated???? To my observation None.

People have reported Approvals with/without RFE only for cases that have first FP not yet expired. OR RFE issued before first FP expired...., after RFE was answered/recieved..., 2nd FP issued. There are not many cases with second type.

By following the trackers June - Dec 2002 trackers..., 99% sure..., my instincts are saying...
USCIS is waiting for 2nd FP candidates to apply for 3rd EAD...., so as to collect some revenue..., before approving 485..., so as to compensate 2nd FP expenditure.
I know people can say my observation is wrong..., then why are 485 cases getting status update only after applying for an extension of EAD????
 
I know in couple of cases (from rupnet data), those who are fingerprinted in April, are sent RFE notice. But I am not sure if they applied for their 3rd EAD.
So your interpretation seems to be interesting, but I doubt BCIS is following any rule,as they are so unpredictable.

But my case supports your point.
 
I would be one of those cases. 2nd FP done in December 03. RD Mar 02 RFE Mar 24 04 , RFE Rec'd Apr 23. APL May 7

Good to hear from you. You have not mentioned whether you applied for 3rd EAD. Your RFE is past your RD anniversary. Incase you applied for 3rd EAD, by what date did you apply for your 3rd EAD?
 
I applied for 3rd EAD for my wife, 2nd for me (I was a H1-B) wifes was applied for 3/19 and is still pending, I figure they won't be sending me a refund. Here are all of the details.

Your case is no exception, my guess/analysis is still correct.
Your 2nd FP Dec-20-2003,
You submitted EAD fee for your wife on Mar 19, 2004
your RFE was generated in Apr 2004...., your RFE was generated only after one of you had paid EAD fee....
I am still waiting for somebody to prove my observation is wrong!!!!

hi peace_of_mind: I think your obersavition might be correct. I also had the same feeling. I completed my 2nd FP and still waiting. Also my obersvation is RFE is issued for people who completed 2nd FP between 60 to 90 days from the date when 2nd FP was done. This is just my analysis through some light to this.

In accordance to your observation if 60-90 days is correct..., then my observation would be purely coincidence..., I wish my observation is purely coincidence..., if not most of us (including Dec 2002 applicants who had 2nd FP) would have to pay another EAD fee..., implies..., approvals would be close to RD anniversay date....
Also, right from begining of this year..., our attorney was mentioning that our approvals would come in Sep 2004. Last week she again said, I should not bother until Sep 2004. Our attorney is a member of AILA / ALIA.
Now I suspect AILA might have suspected/guessed/understood regarding the Fee collection...., but they may not be ready to express it to the general public!!!!
 
Your theory may be right. USCIS may be greedy enough to gulp the EAD/AP fees. But, there are instances when the EAD dates and RD dates may not be same.

For instance, I did not apply for EAD/AP with my I-485 (I was on H1 then). I applied for them when my H1 6-yr limit reached. Thus my I-485 RD is JUN 02 whereas my EAD RDs are around FEB 03/FEB 04(2nd EAD). Thus, if they wait to get my EAD fee, I may have to wait till NOV/DEC 2004 (Unless I decide to just pay the EAD fee earlier than necessary, hoipng to get my approval in return).

My case got approved after 2nd FP.

I have filed for my 3rd EAD last month and still no 2nd FP or any RFE or Approval.

Sorry I was talking with 2nd FP already issued..., In your case if you have not got 2nd FP, then at least mention the date of 1st FP.
 
I got my 1st FP on 12/01/2002.
Do you think that at least we must have our 2nd FP done before approval?

I have applied for 3rd EAD and got approval in 45 days. I had a 2nd FP before 3rd EAD. NO RFE OR AD.

No I didnt use AC21 or change employer during the pendency of my whole process (from labor through I-485).

I believe your 2nd FP was on April 2004 and not on 2002. If thats the case then you should expect approval within a month. My attorney had told me a while ago that NSC is currently preparing all employment based adjustments for adjudication which were filed December 2002 or earlier. Cases are deemed "adjudication ready" when fingerprints and the FBI name checks are completed.

Is your Name Check complete. Check with the FBI Name Check program.
