Hi,
My Labor got cleared.
I am on H-1 visa and planning to do Concurrent filing of I-140/I485.
My wife is in F-1 status currently and has completed her studies and has One year EAD from Optional Practical Training(OPT) .My wife in the current F-1 status (with EAD from OPT) was included as a dependent on my I-485 filing .We now had also applied her for the EAD and AP based on my employment based I-485 petition. Can she get dependent based EAD card also now as she already holds a F1 OPT EAD right now.
Is there any restriction/precaution we need to take while using the two EADs.
Please help on this issue.

Thanks,
Murali

Dual Ead

In my own experience, I did have dual EADs, running in the same time (in 2002), one based on labor certification, the other one on an old case.
I did not understand why they didn't say anything: just because different departments don't comunicate with eachother, and the INS officers were not required to make connections.
At the end I just stopped renewing one thread.
Well, maybe two is better than nothing..

I dont think there is any problem having two. but i would suggest to use the F1 opt since it allows you to not give for SS and medicare. so it would financially better to use the F1 OPT. so use that fully and then use the other one. it will save about 400$ x number of months.

You're confusing immigration and taxation issues. There's nothing inherent in the EAD you use that allows you to save on SS and Medicare taxes; it's the wife's F-1 status. Once she files the I-485 she will lose her F-1 exemption from FICA taxes, and will be subjecto them.

The only different between the OPT EAD and the regular one is that the OPT is restricted in the types of jobs she can take; they must be related to her field of study. The tax consequences will be the same.
