Cut-Off Dates for Immigrant Visas
We are pleased to announce the April 2008 cut-off dates for immigrant visas for individuals born in India and those born in most other countries.

To qualify for an appointment, an applicant's priority date (the date that the petition was filed) must fall before the cut-off date for the appropriate category.

The following numbers are derived from the Department of State's Visa Bulletin. If you have additional questions about cut-off dates and your case is being processed at the U.S. Consulate General in Mumbai, please e-mail us or call us at +91-22-2363-7407 between 2 and 4 p.m. IST.

Could the dates be same in the bulletin released by DOS here in US ? If thats true really good news for EB2 :D

So India EB2 is Dec 2003? Good for me (and others who fall in the same category).
But do they have visa numbers? Also will those idiots work on a FIFO basis?
AND if everything works out correctly, will this actually translate into approvals?
Yeah, I'm a hardened cynic.
 
Before few weeks, some one predicted after talking with the person who is setting PDs. EB2 India would be Dec 2003 in April VB. He is correct!
He put forward the logic as follow
EB2 India consumed all alloted visa for FY 2008. But there are lot of visa available in EB1 category for FY 2008. EB1 is current for all including India and China. Unused Eb1 visas will go to EB2 category. As EB2 is current except EB2 India, all EB1 unused visa will go to EB2 India.

It is possible that EB 2 India may move forward in coming months. But you never know USCIS and State Dept.!!

Mr. Oppenheim is the officer within the Visa Office tasked with calculating visa bulletin cutoff dates each month. He offered the following thoughts as to cutoff date movement in the upcoming months:

In April, India and China EB2 will be set at 12/01/2003
EB3 for India and China will slow down for the rest of the fiscal year."

I am riveted by this because I spoke to Oppenheim just the day before this meeting (he referred to it). This was the conversation in which he told me that at present EB-2 India would only get numbers leftover from EB-1 India -- the problem is he doesn't know either exactly how many EB-2 India adjudicated applications there are in any specific PD range -- so every month he makes wild guesses, with the intent of using up visas. So I guess at least as of 2/14/08 he thought moving the date to 12/1/03 would more than mop up whatever was leftover from EB-1 India. Given the end of the FBI boondoggle (the effects of which have not been quantified by Oppenheim or USCIS) I'd predict that even a date in early 2002 would be good enough to mop up. Let us see if he changes his mind by mid March.

another chance

I missed the bus many times in the past. i am alive again with April visa bulletin. Will this be my time?
 
All I can say is that this will be reflected in the April VB.
Waiting with a PD os 12/2001 and...uhhh...still to clear NC.

Now, for India EB2 , i believe there could be thousands competing for a few hundred visa numbers ,with PD 2000,2001 ( labor subs, EB3 jumpers etc).
Since they don't know FIFO, there is chance that person with PD Nov.2003 and RD July 2007 could get approved.
 
Once PD is current, USCIS is approving by RD (receive Date) of I 485. For Example, EB2 India has Cut off date Dec 2003. USCIS will arrange per RD of I 485 for all cases have PD before Dec 2003. System was messed up due to Labor delays, labor substitution, and Name checks.
I am sure, once your PD is current and name check is clear, they will go through RD of I 485.

Ok this will give hope to some people who qualifies with these dates. Can anyone please tell what date they mean as Timeframe in processing times webpage for each process. For example I-485 in Texas center shows as April 10 2007. Is this the date of I-485 receipt date or Notice date.

I know I need to wait till it comes to my date. But my date for I-485 are
Receipt Date: June 18,2007. Notice Date is July 16, 2007. So till which date I need to wait for USCIS to work on my file, as I believe my PD is current from April 1,2008

Receipt date is the important thing. Notice date is when they printed the receipt notice and sent it to you, which may be days or weeks after the receipt date.
 
If the PD is current next month and stuck in NC . Based on the new name check - 180 days rule, will these type of cases be eligible for approval?

Tomorrow, Check USCIS link again. It has taken out from USCIS web today evening for some reason.
