We are green card holders here in USA. We already petitioned our daughter who is still in the philippines. Actually we already received a notice that her petition is already approved. She submitted the documents including our affidavit of support and others required by the US consulate in the Philippines last October 2004. Now shes just waiting for her interview. But then we are worried that she'll be turning 21 yrs. on April 26. If in case she reach 21 yrs. and still was not interviewed will her application be affected? Pls. advice us. my email address in ernestoespanol@myacc.net

Under the CSPA, if you are a lawful permanent resident and you file a Form I-130 on behalf of your child before he or she turns 21, your child’s age will be determined using the date that the priority date of the Form I-130 becomes current, minus the number of days that the Form I-130 is pending. In addition, your child must seek to acquire the status of a lawful permanent resident within one year of visa availability. This provision also applies to derivative beneficiaries on family-based and employment-based petitions.

Good Luck
