Wow, I can't believe it. I just got the magic email at 10:45PM Central Time. Both my and my wife's I485 have been approved! Looks like all those LUDs did mean something after all.

Since they received the application 6/7/2007 and we got the approval 9/4/2007, that's less than three months to approval. I never dared believe that would actually happen to me, but I'm so relieved now.

Good luck to everyone else, and remember not to believe what the IOs tell you, and don't think you can't get approved until your PD is current!

You can't get assigned a visa number until your PD is current, but you can still be approved if retrogression makes your PD become not current after a visa number was already assigned to your case.

Your PD was current in June, and again in July after they reinstated the "all current" July bulletin. So your visa number must have been assigned sometime back then, but it took them a few more weeks to complete the paperwork to get your case approved.

That's possible, but who knows what USCIS is doing behind the scenes, especially these last crazy months. People have been told that visa numbers haven't been assigned but have been approved shortly thereafter even though their PDs weren't current.

They're also not supposed to assign visa numbers until the case is ready to be approved, but when I called not long ago (when I wasn't current) they told me name checks etc. were still pending, so technically they shouldn't have assigned me a visa number then, and they shouldn't have assigned me a visa number after that.

So are the IOs clueless or do USCIS not follow all the rules? I think probably both. :)

(p.s., I think Jack is most certainly right. As for the July visa fiasco, apparently CIS pre-requested visa numbers for pending cases that were technically not "approval-ready" and assigned those numbers to them, regardless of their NC status. Of course, this is usually NOT how they process pending cases, as you said. So, this time, it is possible that a number was allotted to your case in July and your NC got cleared right after. Or the IO who said your NC was pending simply didn't know what s/he was talking about. Who knows).

It is still true that at the time of assigning the visa number, your PD must have been current (even if it isn't necessarily true that NC and everything else must be completed before assigning the visa number). Nobody on this board reported getting approved when their PD was not current at the time of approval nor current at any time within the last 1 or 2 months prior to approval.

I have seen approvals in the last few days that pd's were not current neither under august or September VB

But everybody was current in July, after they reinstated the "all current" bulletin. That is within the 1 or 2 month time frame that I mentioned.
 
And how does one knows if visa # was preallocated to any case. Does name check has anything to do with it, or is nc clearance a random, independent event?
My nc is cleared according to IO but I dont think she knows if a visa number was "pre-given" to me.
