Approved I-130 while my brother got married and case was sent back to INS by NVC

Desperate Need of Help

My Father had filled a petition (I-130) for my brother (Over 21) in 2001. At the time my father was not citizen. His I-i30 got approved in 2005. He got married in 2003 while my father never bothered to update his status with INS. My father became US Citizen in 2006. My father sent his citizenship certificate to the USCIS so they can update the petition. Mean time INS sent the case to NVC. Once they contacted us we told them that he is married now. They sent the case back to USCIS for further processing on Dec 26,2006. Since then his case is pending. We have contacted USCIS several time but not progress. Every time they send the letter saying that they are actively processing these pending cases. What can we do at this point since its been close to year now.

Your bro's I-130 was voided since he got married in 2003 when your dad was still a permanent resident. Now your dad has to reapply for I-130 for your bro based on F3 (Married child of US citizen).
