Hi All,
Its finally done!!! Many thanks to Rajiv Khanna and all the users of this forum as well as Rupnet (will update). You have all helped me get through this. If you have seen some of my other posts you might remember that my situation is a strange one...My parents used to live here 30 yrs ago and I grew up here. I think I have set a GUINESS RECORD for longest time between first setting foot in this country and obtaining my individual permanent residency (30 yrs ago I was a dependent)!!!! Let me know where to apply...if they dont admit me maybe they will at least send me a case of Guiness beer...maybe I should send all of you a case of Guiness...maybe I should drink a case of Guiness...I am delirious and I haven't even started drinking!!!!!! I will continue to be a part of these forums as much as I can. Hang in there guys...

A couple of remarks: I shifted employers using AC21. My emp letter to INS (in response to RFE) just mentioned that I was with a new employer and that my job title and responsibilities were about the same as my earlier job.

My wife is yet to be approved. but i dont anticipate any problems.

Just curious: what was your status during the past 30 years or so? Why waited until this late to adjust status? Never mind.

Regarding my status, my parents returned to India after some years and everything lapsed. My dad did not care about things such as his permanent residency etc. I came back to the U.S many years later as a student (F1 Visa etc). So I am not say I have been continuously living here for 30 years!!!!! The first time I set foot here was about thirty years ago ( I was a toddler then) and I did some of my schooling here. :D

sample emp. letter? I am working for contract full time. how detail does a letter need to be. salary, duties meets with previous but only difference is contract vs. regular (which can be omitted). please provide your input.

This letter is to confirm YOUR NAME'S full time employment as a JOB TITLE with COMPANY NAME. YOUR NAME'S duties include YOUR DUTIES. YOUR NAME is a highly qualified YOUR PROFESSION with a PH.D whose services are of vital importance to the company. YOUR NAME has been a JOB TITLE at COMPANY NAME since START DATE.
YOUR NAME is performing the same duties as a JOB TITLE with YOUR COMPANY as he was performing with YOUR PREVIOUS COMPANY. The employer changed but his job assignments and duties did not.YOUR NAME'S current salary is over $XXX per annum.
Your assistance in granting the requested Permanent Status in the USA would be greatly appreciated. Feel free to contact me if you have any questions.

Remarks: My attorney took the view that the letter should be as simple as possible. I did not send any accompanying documents such as paystubs etc. It worked for me ...hope this helps

I too set foot as a toddler in the U.S. in 1971 when my parents came here to study and then work. I studied here till the 6th grade. In the meantime my sister was born here.

However just like in your case my parents returned to India to contribute there and really didn't care about permanent residency.
When my sister turned 21 yrs old, being a U.S. citizen she wanted to come here and continue her education and insisted my parents return to the U.S. with her. So my sister filed papers for them in the immediate relative category and they got GC in six months. Guess who got left behind - ME, I was married and over 21 yrs old, so my parents couldn't file GC since they were not citizens. I had to come here on my own on H1 and even though my parents have become U.S. citizens about a couple years ago, There no point for them to file GC since I was already in I-485 stage. By the way my sister did file GC for me when I was in India, but I never really was excited about that due to the long backlog in priority dates.

I am in TSC and it looks like it's taking for ever. I can relate to your elation in finally getting the GC and look forward to that day myself.

Congratulations!!!..nice to see your appoval.

I read your lot of past/previous postings..and used to follow your case closly since I am also in similar situation as yours. I have changed the employer(took full time position with client) after 11 months of filing I-485 but current salary is 5K less than that mentioned in the LC.

Quick question: Does your current salary is more (or LESS) than LC salary? Did you change the Attorney when you switched the employer? Did you inform INS when you changed? Do you think INS create's more problems if the salary is lower than LC salary?..any idea?..

I would really appreciate your inputs.

Here are my thoughts on your qs:

1.Current Salary: Fortunately my current salary is substantially more than what was stated in the labor app.

2. I did not change attorneys after shifting companies...the situation was the following:

My former employer had stopped paying their bills to the law firm long ago and I had to foot the bill for Ead/parole etc....so the law firm did not seem to mind that I continue with them even after leaving my former employer.
By the way my former employer was a fairly large public Ltd company (not a fly by night operation)...unfortunately the management at the top were a bunch of utter SCOUNDRELS!!!!!

3. I did not inform INS when I changed jobs since there is no mandate to do so. When I received the RFE I sent the letter (see an earlier post in this thread) and that was it.

4. Here is my guess...the fact that a salary has slightly decreased may not be a problem...where it might be an issue is if it falls below the prevailing wage. In this case the orginal labor petition may be in jeopardy. Again, this is just my common sense reasoning, not a legal opinion.
