Approved (Future Employment)

Hello All....

I have been a silent visitor on this forum for a very long time and finally today is my day to say "I am approved".

Got "Card Production ordered" email last night at 10:15 PM and "Approval Notice sent" today morning at 8 AM.

I think I owe it to this forum to provide my details as this forum has helped me a lot during this roller coaster ride.

Labour: EB3 PD Dec 2001 (AD:Feb 2004)
I-140: AD: May 2004
I-485: RD: Sept-2004
FP1 Apr 2005
Transfer VSC-->> TSC : 03-02-2007 (Transfer)
FP2 05/05/2007
I-485 AD:Aug 1st 2007
Never called any service center, Never took Info pass....Never spoke to any immigration officer.

We should keep our mouth shut and not writing letters to get our I-485 approved ;)

Your employer is right (as long as i-140 is approved and i-485 is pending for 180 days you are elegible

First of all Congratulations.

You mentioned that your case is Future Employment, Did you ever work for the sponsoring employer ? If not do you have to work for the sponsoring company now ?

I am also in the same boat and got the GC approved last month and i am planning to work for the sponsor company to avoid issues during the citizenship process.

As per my understanding, GC is future employment. You have to work for your employer atleast 6 months after your I-485 has been filed.
 
But my current employer says ...

A person is eligible to work for any company he chooses by using AC21 and that AC21 is applicable for everybody (future and current) as long as their 485 is pending for more than 6 months. It doesn't really say that upon approval the employee needs to join the sponsoring company. The important thing to keep in mind is that the job profile should be same or similar.

Zeemar...I did worked for my sponsoring employer for 4 years but I left him before my labor was approved. My old employer continued my GC after I left. The sponsoring company got sold once my 485 was pending for approx 2 years.
