Approved!!! Complicated Cases, I140 CP, applied AOS

02/01/02 - Came to know from INS, Nebraska that an inquiry has been sent to NVC to locate the CP approved I-140 file on Nov 15, 2001. They will wait NVC to respond for 120 days after Nov. 15. If no reply from NVC, they will resume processing.

02/04/02 - Called NVC - Told me taht they do not have the file and most probably, the file is with Delhi Consulate. Requested repeatedly to them to respond to the INS, Nebraska request to return the file by at least saying the file is with Delhi.

02/25/02 - Eventually, NVC forwarded INS request dated Nov 15, 2000 to Delhi consulate to return approved I-140 file to INS, Nebraska. I think this did it..!!!

AD - 03/15/02 - Recieved approval notice dated 03/15/02. AVM not updated

So guts, this is my story..
I have put in all the info here.., I will try to answer any questions you folks would have..

I I140 is in Chennai now. I checked with NVC today too.
They say, they have not yet received any inquiry from NSC.
I have no idea how to check what NSC is doing now!?
Did an IIO tell you about the I140 inquiry with NVC?
Or did you learn from other source like Lawyer or something else?

Congratulations. One question for you. When you called IIO did he anytime gave you following reason for delay in your case.

"Your case has been sent to make connection with you I140 file"

Answers..

When I spoke to IIO in INS, Nebraska on Feb 01, he told me that they have sent the request/enquiry to NVC to return my file. (and also told me about the 120 days). After that I did not talk to IIO. I followed up with NVC only.
On Feb 4, when I called NVC, they said that they will put in a request to locate my file - vaguely said that it might be here or in Delhi.
They told me to call back after 10 days. This kept on going till Feb end when I found out that NVC has sent the request further on to Delhi to return the file to INS.

I think it would probably be better to send a fax or so to NVC and also cc to consulate in India.. (an after-thought).

Achiever, I did\'nt get the exact verbatim reply.., but I was told that INS Nebraska has sent a request to NVC on Nov 15, 2000.

Though my I140 was for AOS & was never for CP, I don\'t know why they gave that reason.

IMPT :How do we know

even if we asked for AOS,that the I-140 was approved for CP??
What kind of text is present on the I-140 approval??

your I140 approval notice should say specifically

Your I140 approval notice should say that "This person is in US & is planning to apply for adjustment of status... This file will remain at this service center"

I am not sure what it says if you applied I140 for CP.

my i-140 approval does not say that..so I think I shall be in the same boat as so many others..and have to wait for several years ...even though I specifically ticked AOS

Too late...

called NVC..and found out I140 papers are in Consulate in INdia..so I know my approval will take another 2 yrs..I am so bummed out..I am planning to report my lawyer..

What did you mean by "report my lawyer?" Not sure I understand you.
 
To AILA - because she screwed up

We Had not asked for CP ,and yet she sent the papers to the indian consulate,and even after the packet was sent to her,she never informed us,etc..basically she is taking us for a ride,and I have had enuf...

So I am planning to take up action with AILA
It wont to any good,as my case is screwed up anyways,but I am not going to let some b* in a law firm decide when and how I get so stay in a country,when I am a law abiding,heavy tax paying,resident..
 
DO all of you have your I-140 applied in NSC?

Just trying to find some ray of hope ...do all of u have ur I-140s applied in NSC??
Is there a letter we can send to INS,directly,stating r I-140 papers are with the COnsulate in r home country??
Any ideas???

Why don\'t you talk to your lawyer again?

I would suggest you to call consulate in India & find out if your I140 papers are still with them or not.

Noting will happen if you go after your lawyer. All she will say to you is to find yourself other lawyer

Also ask your local senator\'s office to find out where exactly your I140 file is.

We did talk to r lawyer..and I called up NVC too,and they mentioned the I140 is in the Bombay Consulate in INdia..but I dont know if I can send a fax or something my self to INS NSC mentioning my I140 is in INdia
 
Sdey, first call up bombay consulate(No fax, call up)

& confirm if your I140 papers are with them or not. If you are lucky then your papers should already on their way back to NSC.

Or instead of you calling up let your lawyer call up bombay consulate. That way you will know how your lawyer works. If she is proactive then it is OK. If she is stupid then you can fire her.

Also what did your lawyer say about this mess?

she said it\'s normal..And nothing to worry abt..papers will be with NSC..blah blah blah..I mean I am so bummed out I cant tell u..
r case was so simple.nothing complicated..no job changes..no address changes..in fact I was blisfully unaware,until I read all these posts.and decided to check my I140 again.
