Approval while Outside of USA

Hi Friends

I have a H1B visa valid till Jan 2004 and I expect to hear decison on my 485 approval only after September 2003 ( My RD is 4/2002) going by current VSC timings.

I know that I can use H1 visa to go out of US and come back till the visa expiry date with out having to apply and use Advance Parole.

But if my 485 is approved when I am away from USA Can I still use H1 to enter or I need to have AP? Just a mere approval of 485 invalidates H1 for Reentry ?

Yes you can use H1 to enter. Mere approval of I485 does not invalidate H1. Since h1 and 485 approved/pending can coexist it does not matter. Once you get the 485 stamped and get the green card you should not use H visa anymore.
