Approval time question?

Hi all,
I am curious to know if the state from which you apply makes a difference in the time it takes for approval.
some times we see an approval in a couple of months , some more than a year and recently one in just a week. Just wanted to know if NY state appliers face the same fate as LC approval times even with the EB1 category approvals

that leads to my next question.
Is there a rule that says that a person from a specific state can only apply at a particular center??
I understand that since OR requires the employer to file for it, If I am working in NY, then is it a must that they file at VSC or do they have a choice.
If I do NIW, since I dont need an employer, can I apply at any center or am I still bound to apply at VSC since I am a NY state resident?

You have to apply at VSC.

Yes it does. The state you (your employer) are in determines which Service Center processes your application, and processing times are different for different SC's.
 
Something to look into ...

If your company has a headquarters located elsewhere, not in NY state, it might be possible to apply through the Service Center covering your company's headquaters location.

Definitely consult with your immigration lawyer first.

thanks for the clarification.
based on this info and from my friends applications, i think people from NY, NJ and VT have to aply at the VSC
but is there a difference in the prcoessing time when applying to the same SC, but from different states
i am asking this because my wife is starting to apply for jobs. if applying to the VSC from vermont gets the process done faster than applying from NY, then she can look for a job in VT.

I do not think it matters from which particular state you apply as long as you belong to Vermont SC jurisdiction. Every application is assigned a EAC number which reflects only the Notice Date for your application. No reference to the state you applied from. And then the long wait starts.

But any of the applications can be pulled from that line and approved - randomly.

In any case, if your wife is a primary applicant or derivative applicant - it does not affect the wait based on from which state (within VSC jurisdiction) your application is coming from.
