Dear Sir / Mam,
I am an American living in The Netherlands married to a Dutch man. We have been already married 7 years. I originally come from Puerto Rico. We got married in Maui, Hawaii.
I am well informed on how to apply for an immigrant visa (immediate relative) for my Dutch husband at the American Consulate in Amsterdam. I have read different websites from the USA agencies over the requirements, etc for the visa's. I am looking answers for the following 2 questions.
I urgently need to come back to Puerto Rico. As an American citizen from Puerto Rico, I can just go back. My husband could come with me but he would be allowed to stay up to 90 days. After the 90 days, I would not have to go back to The Netherlands but he would. could we apply for a resident visa for him while he is legaly visiting Puerto Rico? Or would he have to go back to NL within 90 days?
The other question is about application I-864 Affidavit of Support. If I live in The Netherlands with him, how can I show prove of support for him if I will be moving back to PR and I would not have a job at the moment I move? I would be able to prove that with my education and work experience I should be able to get a job with a salary between 35.000 en 50.000 dollars which is higher than de 125% of the poberty guidelines for household of two (16,037 dollars). My last job in The Netherlands was self-employed and we had to close our business down due to low turn-over. I was employed before that in The Netherlands with a yearly salary of 40.000 euros plus bonus and company car. I could not think I would have to move first without him, get a job and then bring him with me. What if my spouse already depend on my income in The Netherlands to support himself? He only earn 20.000 per year and he could be lossing his job shortly (temporary contracts). I could not live him behind. What if the reason we want to move back to PR is because we have little money and we know that we have better opportunities in Puerto Rico, my land? Do we have to have money, assest, etc so we can move? I know, I can move even if I have no cent at all, but what about him?
