Hi All

I am ready to file N400 next week and wanted to double check following:

1. My wife worked as sales associate in departmental stores, I am putting same info. Is that ok? I guess, I am not worried, but, does she also should be doing job only related to IT as she got GC thru me which is IT job? I don't think so. is this correct and she can do any non IT related job. Please clarify.

2. My wife had 2 trips to India, one with period of 5 months and 1 Day. other trip with 1 month. Hope 5months 1 days trip should be ok. (it is still 'No' for Did trip last six months or more).

3. Does "your occupation" should be exactly stated in labor/GC process? I did put like Senior software engineer. And that's what I remember for me, it could have been just software engineer. is that ok ?

4. We are NOT applying N400 for our indian born child. I went thru N400 guide and child can apply later once parents receives their citizenship. Is that ok ?

5. I had to mention couple of items:
1. had only 3 speeding voilation tickets - no charges filed, paid fee. didn't had record for one. Still I am mentioning all 3 tickets. with "Yes" to answer for Q16 (have you ever been arrested, cited etc)...is that ok?
2. never filed as NR but as a contracter filed NR/Part Year forms (offcourse, only filed as Part-year)
3. Selective services- never applied - i wasn't eligible.
4. had to leave company 1yr after getting GC.
5. AFTER GETTING GC I HAD TO WORK IN ONE COMPANY ONLY for 3 months as FULL TIME. Got to resign due to personal reasons to come back to home state and took other full time job in home state. Is that ok?

Last q. Do you think I need a lawyer to file my N400 ? I think I should be able to apply myself.

1. It's independent, she doesn't have to have same job category as you if she obtained the GC through you. You're fine with this.
2. This is fine. No trips of more than 6 months.
3. I don't think software engineer or senior software engineer is going to make any difference for this application.
4. If child has GC and lives with you in the U.S. child will become citizen automatically when you naturalize. Then you can apply for passport or for a certificate of citizenship (with form N-600).
5.
1.This is not my area of expertise because I didn't have tickets. My take is be prepared to take court dispositions or proof that you paid the tickets with you to the interview. If possible you could send copies with your application, but it should be fine just to take it at interview time.
2. I'm not sure whether I am getting this. The question on the application is if you filed tax return as non-resident, and I think it refers to federal, some people have income from different states and file non-resident in some of the states. I believe that's fine.
3. That's ok, some people ask selective services for a status letter, but I think it is a waste of time.
4 and 5 seem conflicting. How long did you work for your sponsoring company?

It doesn't look to me that you need a lawyer, your case seems pretty straightforward to me. The great majority of people have cases similar to yours, with a few traffic tickets and some job changes. You need to clarify if you ever filed a federal tax return as non-resident after you obtained your GC.

When you (eventually) prepare for your interview, you'll ask your employer for a Letter of Employment. This will help you establish evidence that you work for your employer as stated in the N-400. Please think of what the Human Resources will be filling out and what stands on your business cards (you may take them to the interview as well). If HR and your business cards state "Senior Software Engineer", it is what you should enter. If they state "Software Engineer", it is what you should enter. The general idea is being consistent.

As Huracan writes, it probably does not make any difference for the USCIS.

Still, even if you fill it out to the best of your knowledge and for example fill out "Senior Software Engineer", I do not think you would refuse to be promoted to "Principal Software Engineer" just because you entered "Senior Software Engineer" on your application. :) If this was the case (if you got promoted after you submitted the N-400, you would have the possibility of providing an update at the interview and say "Oh, I have been promoted to Principal Software Engineer" and my best guess is that the IO would congratulate you on your promotion. :)

Document check lists ????

Regarding NR, I have not filed federal tax return as non-resident. Also, I am saying that I filed state tax returns only as part-year (but some state tax forms have title like NR/NY)
I did work with sponsoring company for 1 year, they initally laid off and took me back again. But, I resigned afterwards.
Then, in last five years, I had to resign from one company after working for 3 months only, and ,had to return to home state and took other job.

I hope this should be fine.

Also, I had another q on documents needs to send along with application. (the way I understood from document checklists)
I am thinking to attach following for each application separately for myself & wife.
1. GC copies
2. photos
3. check
4. IRS tax returns for last 3 years.
5. do i need to send "completed original form g-325b "biographic information" -- Confused from document checklist ? Do I need send this ?

I do have a citation for just speeding ticket. but, i don't have record for this. I am trying to get the court statement saying no record exists. I am not
sure if i can get it by next week? do I must have it to file N400? or I need to send this at all?

Do I need any miss any additional documents to send along with ?
