------------------Visa is applied out of US once H1 petiton is approved by USCIS. Do you mean his L1 to H1 transfer petitin got denied? what was the reason given by USCIS on denial letter? all depends on the reason given on the letter from USCIS.
But the visa got rejected.Is it possible to apply H1 visa now through other consultants since the quotas are still vacant.?
RFE is for missing document or more information. missing document or more document can be from H1 employer or from your spouse. Lawyer or employer who filed H1 gets the RFE from USCIS. what the USCIS asked should be on RFE letter. I dont have the copy of RFE letter and cant provide more info. let your spouse talk to Lawyer or employer who filed L1 to H1. FYI at this time USCIS is asking lot of documents from employer. USCIS is rejecting H1 filed by H1 Consulting companies. It seems that your spouse filed L1 to H1 transfer through consulting company.Yes it is regarding L1 to H1 transfer.He applied this Dec 06,2009 for the second time..But they have asked for RFE.Last time also it got rejected for the same reason.What could be the reason for RFE?
