Hi All,

I need help with this situation. I lost my job and found new job. Now, if I apply I-129 via premium processing online and if it gets rejected, how much will I have to leave. Would it be still 60 days or I have to leave immediately. Also, if it gets rejected, can i still apply for I-539 for extension?

The I-129 denial should not affect your grace period. You could still file I-530 for B2, but you should be preparing to leave US at that point.

Thanks Nelsona. One follow up question in these scenarios

- If I apply I-129 during grace period, will I get I-94 or I will have to go to border to get it.
- If I apply I-129 after applying for change of status to B2 ( I-539), will i get I-94 or I will have to go to border to get it.

Thanks.

You should get an I-94 in either case, because the current I-94 number you submit would be valid at the time of submission.
