Applying h4 cos and h1b at the same time ..

Hi,

I am currently on L1 Visa in USA through company A. Company B is ready to apply H1B for Oct'06.
My questions:
1. My new h1b will be valid only from October 06. But if i have to leave the comapny A before oct 01st, will i be out of status or will i be IN status as h1b app is PENDING ?
2. If above case is not valid, then how about applying for H4 COS on my husband's h1b visa to maintain status till october and then applying for h1b with start date of oct 01st ?
3. Can i apply for h1b while L1 to H4 COS is pending ?

You will be L1 until Oct 1, 2006.

If you are not able to keep up with L1 status better go for H4 until Oct 1, 2006.

Thanks for the reply GreatGuru.

If i apply for H4 COS this week from L1b, then will i be considered "IN STATUS" after H4 COS app reaches USCIS or i will have to wait till it is approved to maintain status ?

Also, Can i apply for h1b from another company while L1 to H4 COS application is IN PROGRESS ?
