Applying GC for Brother in Law

Hello,

Me and my wife both recently got US Citizenship. My wife wants to file GC for her brother who has a wife and a 2-3 year son.

My Questions Are:
- Do we need to file GC for All three? Or just file for her Brother? We need GC for all.
- Considering the current statistics that family based GC takes about 12 to 15 years to process.... Does the person applying for GC should be residing in US all time during the application Process. I am in double mind and may even plan to go back to India for good.... Not sure but there is a possibility. So in this case will the application be denied? or would i have to show the proof of US residence and W2 etc for Support Documents?

I would think that you would have to file I-130 for each person, but I am not sure. You can ask in the family based immigration forum for a definative answer.

As for your wife not residing in US while your brother-in-law waits for a visa number, that should be OK.
