Applying for Spouse

Dear All,

I am single right now and have filed for my I-485 back in 03/2003 (ND 03/2003). I am thinking about getting married sometime late next year or early 2005. Do you know if its easier to apply for the GC for my spouse after I receive my GC or while I am waiting for my I-485? If I get married while I'm still waiting for the I-485, can I file another application for my new spouse. I am afraid that in the unlikely but lucky even of me getting my GC before end of next year, I'll have even more trouble applying for GC for my spouse. Thanks in advance!!

My understanding is that if you get married before your I-485 is adjudicated and your status is changed to lawful permanent resident, then your spouse gets adjusted also automatically if you apply for your spouse on I-485.

If, however, you get your green card and then get married, the wait time can be from 3-5 years for you to "sponsor" your spouse, AND your spouse can't stay in the U.S. during this period unless your spouse qualifies for their own H1-B, or other lawful visa independent of you.

So you should probably bump up your wedding date and apply immediately to avoid this problem.

Speak to your lawyer to confirm all of this, as I am not a lawyer.

Yes

you need to get married soon.
An approved GC will delay your wife to come to the US and live with you.

Thanks to both of you that have answered my question. So she won't even be able to stay in the US during the application period? She is currently under practical training, but given the current economy, I'm a bit worried about her finding a job that would sponsor her H1-B visa. But then I don't really want to push things forward since it'll make things too soon. In fact, it'll really suprise her if she sees this question that I posted.
