Applying for NIW - please evaluate credentials

Dear Friends

I am in the process of putting my packet together for a petition through NIW (through a lawyer)
 Some of my qualifications are as follows:

1. Currently NIH post doc researcher at Harvard Medical School.
    -- project deals with developing peptide derived drugs against protein dramatically aggressive
in development of cancers and metastasis. This protein was center of world attention - articles in
NY times, Time mag, Newsweek, Boston Globe, Japan Times etc (have all clippings) plus TV
footage of CNN and CBS :reports on this protein (have the video tape)

2. Ph. D. awarded in 2001 in Biochemistry/Mol Biol. Ph.D. in the same specialization as present
(in Post Doc). Doctorate from a US university but post doc started in 2000 only due to schedule
conflict for commencement.

3. 5 publications in top Journals - another two being submitted

5. 2 presentations in conferences

6. 2-3 research and teaching related awards

7. 11 letters of recommendations (including editors of journals and deputy directors of research centers)

8. 3 professional memberships solely based on academic qualification.

Please give an opinion of what chances I have of seeing success.

EB1-OR not possible yet

Thanks for your response. Employer will not sign petitiion for a 2 yr old post doc...need to spemd more time in the grind..

any other opinions any one ?

You can apply in EB1-EA and NIW simultaneously, if employer is not sponsoring for EB1-OR. Good Luck!

I don\'t think you have a strong case for either NIW or even OR. Five journal publications is by no means overwhelming, no matter how impactful for your field.

Publications are not the sole condition for a successful EB1 application. You need to satisfy at least one of the following requirements:

- major awards - you list none;
- participation in judging the work of others: you should have reviewed journal papers and prove it or you should have participated in other panels judging the work of others;
- presence of citations of your work in other journal publications
- membership in professional organizations requiring outstanding achievements: I have a hard time believeing that genuine outstanding achievements are required for any professional organization I am aware of

If you feel you fulfill at least one of the requirements above, then you are safe.

n43y, I agree with dboca\'s opinons. I believe you are really an outstanding researcher or scientist in an academic point of view. But INS uses different rules to judge you.

I got my EB1-OR approval without any journal paper bearing my name as the first author. I co-authored 6 papers in several very small journals. But I have more than 10 conference presentations (papers). I have two ministry-level (department in US) awards from my home country, reviewed one paper, chaired one session in a small int\'l conference, has a membership which has lots of special requirements. These are requirements/qualifications listed on I-140.

I hope IIO will accept \'Harvard Medical School = Outstanding\'. Good luck.

Guys Guys Guys (I m assuming)

I am not applying for EB-1 category at all at this point, I may do that in six months when I get my patent and my Nature "Biotech" paper(both in prep) . I mean this is my first year as an H1-B. I am only going through EB2-NIW at this point coz my wife is after my life to get a GC. I do have solid letters (10 from USA) (1 from collaborator in HK)and my mentor has made in pretty clear in his support letter that the project (peptide and protein biotherapeutics against Angiogenin) will come to a stand still if I do not have the freedom to apply for federal funds or international travel flexibility (especially after (9/11) and plus I am needed in this position for another 5-6 years. So I am trying to come up with solid arguments and points to answer INS concern that emerges from the NYSDOT case of 1998. So please evaluate me for EB2-NIW only. I do not beleive I have a strong case for EB1 as of now.
 
For NIW, you must prove you are outstanding first.

To some extent, NIW is more difficult than EB1-OR because NIW has more requirements than EB1-OR. You may notice someone got EB1-EA approval but his/her NIW petition was rejected.
 
It looks to me as if you will have an easier time with the NIW than and EB-1EA

The requirements for the EB-1EA and NIW are similar but they are different is several very important respects. Yours is not an easy case to call and this forum certainly does not make a transfer of information easy (the forum itself is great but it\'s the method of communication that is limited).

You will need to discuss this in detail with the attorney assisting with your filing.

Needless to say, I will thoroughly discuss this with my attorney before this goes any further. This petition ain\'t goin\' anywhere until the lawyer and I are thoroughly satisfied. Please feel free to share any more views.

No Title

You can do OR or NIW based on submitted or accepted papers only. Therefore, you don\'t need to wait until a specific paper gets published. Since I don\'t know the true meaning of "Nature" journal to your field, you can safely assume that the INS bureaucrat evaluating your petition will not know either.

For OR, the INS bean counters want to see additional things besides publications. Review at least one paper and get a letter for it and then you can safely petition. For NIW, you might have a case, it is close to call.

Please do not think that I want to discourage you, I am just offering my opinion by your request.
