Applying for mom's green card

Hi,

My brother has a US citizenship. he wants to apply for my mom's green card.
My mom has a 5 yrs visit visa. She is here in US now, but has to leave in 2 months (6 months requirement). If my brother applies for her green card, does she have to leave the country.She can stay back and wait till her green card is approved. Would that be illegal?

My brother'ss lawyer said, that once he applies for her green card, she loses her visit visa and has to leave US. is that true?

please help!

Does I130 needs to be approved first so that AP can be approved. My mother also has similar case, except for her, we have applied I130, 485 and AP trvel permit all at once.

It has been 3 months and no response on anything
