Applying for H1B visa stamp after marrying with a US citizen

I am currently living in US with H1 visa and I need to go back to China for a short visit. So I plan to go to Canada to get the H1B visa stamp.

I married a US citizen but we have not started the processing of the marriage based Green Card application. Is it considered a high risk for me to go to Canada for getting H1B visa since now I am married to a US citizen and have a strong tie here in United States?

Have anyone done this before?

I really should have started the Green Card application earlier...

If you still maintain your father's name in your passport as well your office , you can get the stamping done without telling the fact that you are married. ie, you should maintain your status as "SINGLE" only, to getthe stamping.

Please consult with your attorney also.
