Applying for Green Card from a US Citizen Sister

Hi

My Sister is currently a Green card holder and on her way to a US citizenship in couple of years. In the next two years I'm planning to start my masters in the US on student visa. While I'm in the US on a student visa, if my Sister applies for a green card for me I want to find out what is the approximate time frame in which I'll get an EAD. I'm not in a hurry to get a green card as my plan is to at least get my EAD before I finish my masters in the US.

I would appreciate if someone who has gone through a similar process of being sponsored by a Non-immediate US relative can tell me the rough time frame in which people usually get an EAD.

You are really misinformed about this stuff. AFTER your sister becomes a USC, she can file an I-130 for you. It will take at least 10 years (some countries take much longer, like the Philippines may take 25 years) just for a visa to become available from that I-130. In that distant future, you may start an immigration process which will likely take another year or so.

IF you are still in the U.S. you will have to be in a lawful non-immigrant status at that time in order to file for adjustment of status. You will probably have a better and faster path to a greencard through employment. Study hard and avoid the J visa!

After she files for you, it would take about 10-11 years for you to become eligible for an EAD through her. And while waiting out the 10 years, her petition doesn't make you eligible for any kind of status so you would have to either leave the US or find another way somehow to stay independently of her petition (e.g. H1B visa). However, with a student visa you can get an OPT EAD to work for a year after graduation in a job that's related to your field of study.

I would advise you to get the student visa and enter the US before she files for you. Otherwise if you apply for the student visa after the immigrant petition has been filed it would decrease your chances of getting the visa.
