Applying for GC for parents CP or AOS ?

Hello Everyone, I've read the very informative thread "GC for Parents - AOS and CP - Information Source". However I still have some questions about the process if someone can answer my questions.

Both my parents are currently here in the US on vistor visa, I don't think they will stay for the whole GC process time here in US if AOS takes too long.
1) Which is better for my situation AOS or CP ?
2) Do CP and AOS have different application forms ?
3) If I choose AOS, can I file for I-485 at the same time ?

Sorry if my questions sound confusing or wrong.

Uhmm hope you know what your nickname means...

1. That depends in their patience, the AOS process can be from 3 to 8 months depends a lot in the speed of your DO. But the same or more can be through CP,depends in the US consulate in their country.
2. Yes.
3. AOS = Adjusment of Status = main form I-485

If they want to adjust their status then check www.uscis.gov for more information in How to bring my Parents to live in the US.

Good luck,

Once I file I-130 and get a response, is that when I submit the I-485, if I choose CP way what would be my next form ? thanks.

Did you check this STICKY thread?

http://www.immigrationportal.com/showthread.php?t=202993

It has most of the info that you are looking for.

In short, you will file I-130 & I-485 package if your parents are in US (AOS).

If your parents are abroad, and if you want to go with CP, then you will file I-130 only at your Service center. Once I-130 is approved, the service center will transfer your case to National visa center. NVC will keep sending you fee bills and forms one after another. Then NVC will transfer the case to the Consulate where your parents will have their interview.

thanks jenimmi, I had read the sticky its just after read 20 pages I was still confused about some stuff thats why I posted this thread. I don't know if you can tell me what happens if my parents leave the country after filling I-130 and I-485, I am still reading the sticky thread as I type.

If you're going to file I-485 for them, then they are going the AOS route. They should technically stay in the US and get their GC before they leave. Unless they want to make a short trip with their AP (I-131) before 485 approval.

Anyway, for I-485 they have to be back in the US, for their AOS interview (in your DO) & approval (with some exceptions were parents I-485 are approved without interview).
