Applying for Citizenship; Question on alcohol related arrest

Hi,

I am applying for Citizenship from Colorado. I had an arrest for DWI (Driving while intoxicated) in the state of Michigan. I did pay $1000 in fines but so far it has never showed up on my driving history. I did not even have any points on the record related to this incident. Even when the insurance companies did a check during policy renewal it did not show up.

Should I mention this in my application. If so, should I obtain any documentation from police or something?

Please advise.

You absolutely have to list it on the application, along with supporting documentation, if it involved DWI or is over $500 or involved an arrest. They will deny your application if they find out about it and you didn't tell them.

Even if you and insurance companies don't see it on your record, the USCIS with the help of FBI has access to purged and expunged records and they treat them as live records. It will be in the FBI records for sure, because you were arrested. People get into trouble when USCIS sees records of arrests and offenses that were purged, expunged or dismissed but were not listed on the N-400.

This all sounds very strange to me!? If you were arrested and booked for DWI, then you must have a police record (need to get a copy for your N400) and you must have gone to court for a hearing, again, which means you'll have a court case file number (neet to get a copy of your N400). Further, your driver's license HAD TO BEEN suspended if you were convicted "guilty" to the DWI which again should show up on your driving record in Michigan.

You're not telling the whole story here. Either way, get all "official certified" records from the court house, the police department, and the DMV (Michigan) and list the incident on your N400.
 
It is true...

I had an out-of-state license and was given a DWI in MI. I did go to the court and pleaded "guilty" ofcourse. The judge simply gave me the file and asked me to go downstairs where I was asked to pay court fees. I paid $$$ (Court fees) and went back to work. My license was returned to me and was not suspended. If it was, the police wouldn't have given it to me. I went back and picked up the car from the towing company. Later I received a letter by mail to pay fines to MI (dep of treasury I think). Maybe they did this because I had a 0.12 on the alocohol test (and they said 0.10 was the allowed limit)...
