Applying for AP from outside US?

HI,

I have an approved AP till Aug 23, 2003. Due to some personal
emergency I had to return to India this month and will not be able to return to US by that time.

How do I apply for a new AP? And where should I apply?
I am a dependent on my husband's employment based I-485 from Texas Service Center . How long will it take to get my application approve and will there be any problems in this?
Can anybody suggest me some solution or has anybody gone through the same situation?

Can we go to local INS office and get the AP? And must I appear at the office personally or can my husband appear on my behalf since I am out of country?

-- If your spouse is on valid H1 and still maintain H1B status you can get H4 visa stamped, you can enter on H4 or need valid AP to re-enter US
How do I apply for a new AP? And where should I apply?
---- You should file AP with your service center before you leave, fill up the form ,pay the fees, 2 photographs, copy of I-485 receipt, I-140 copy, copy of marriage certificate, the write the reason in cover letter.

----- According to BCIS site one should apply for AP while one is IN USA, you should ask your lawyer if any concerns, I don’t think TSC will issue you AP in short time, check the times TSC is taking

---- Many BCIS local service center issue AP and you have to give valid reason for emergency, visit local BCIS local office and find out if they can , you have to appear personally. seek the advice of your lawyer.
