Applying for ADjustment of Status from H-1 after I got laid off

I got laid off on January 29th and I Was on H-1 visa. But my wife is a US Citizen and I am planning to apply for adjustment of status and get a work permit. I have been out of status for a month now. Do i have any problems if i apply for adjustment of status?

is my applying after 4 months for adjustment will be a problem

You shouldn\'t have any problems

You are eligible to adjust as an immediate relative of a US Citizen under INS 245(c)(2). Tell your attorney to look it over and get an opinion.
