Applying for 7th year extension

Hi,

I work for company A, who holds my H1 ... I have till June 2005 before the 6 years are up on my H1 ...

I had company B (future employer) apply for my Green Card ... it has been in process for over a year and 1st part of 1st stage ie., state labor, is cleared, federal is pending ...

In this case can I file for 7th year extension when the H1 is within 6 months of expiry ?

If yes, who all can file it, company A who holds my H1 but didn't apply for GC or company B who is processing my GC but don't hold my H1 ?

------any company can apply for 7th year H1 if LC is pending more than 365 days filed by ANY employer for you and you have the evidence that LC was fuiled 365 days back and evidence it the SESA or SWA reciept that lawyer gets after filing LC from SWA or SESA, you need the copy of that LC filing reciept A or B can file 7th year h1 extension

1) Typically how much time it takes to get this 7th year extension (assuming it gets approved) ?

2) It needs to be stamped once you are out of US, right ?

3) In India I was told that it can be stamped only in Delhi (now) irrespective of the place where your passport is issued. Is that right ?

-depends on service center if you file with Premium processing you get results in 15-20 days after filing

----- if it is Extension you will get new I-94 attached with Approval notice and no need to go out for Visa stamp, next time you go out then you can get Visa stamp

---that is not correct, all the US consulates in India like Madras, Bombay Kalkutta, Delhi stamp the Visa, you need to get Visa stamp from US consulate under your Indian home address. check the US consulate sites in India and learn more
