Apply or Not?

US Citizenship 2006. Pls Help.

HI. I need advise regarding my status to file for Naturalization. Here we go:

My family and I have been lawful residencees of the US since 1985. Every member of my immediate family is a US Citizen except me. I went to grade, middle and high school here. Until one day I decided to go to college in the Philippines. I managed to graduate in 2004. I understand that the immigration only considers your continuous residence for the pass 5 years. Basically, it would mean 2001 from our present year. Every summer while I was studying in the Philippines I would be back to work in the US. I did that for 3 consecutive years. I am now in the US for good working as a flight attendant that does US military charter flights. I am havin issues travelling all over the world since my passport is of my nationality. At times I would get by by showing my crew badge but nonetheless its such a hassle. I am considering filing for Naturalization this year (2006). In addition, my job requires me to be out of the US for 15-20 days a month travelling for the Department of Defense. Considering the sum total of my physical presence is greater than the time Ive been away from the country plus my job duties every month. should I consider applying for Naturalization?

Although I have broken my continuous residency, I have some factors in mind:( based from my research to prove my unintention to abandon my permanent residency)
1. I can prove my ties while I was away from the US as my parents filed my income tax returns every year since I started working at 16.
2. I can prove my job description as my company has provided a letter regarding the type of contracts we do for the military and the reason why I am away from the country every month.
3. I have documents from the college I attended.
4. I have been a resident of my parents' household ever since in which they have previous bills, mortgage and bank statements under their name to support this.
5. I have bank statements and credit card bills since I was 16.
6. I have registered for the civil service at 19 (2002)

Setbacks:
1. In the last 5 years I have been away for a sum total of 27 months however I have been in the country for about 35 months till today.


I am even not considering writing down my trips to the Philippines since the space provided for in the application will fill up from my travel based on my work schedule. And if they ask me, thats when I'll mention it.

Apply or Not?

I was just trying to help you, there is a lawyer who knows much more than us an he could help you.

Nobody said that you can't post here.

In my understanding you can post here and you can try there too...did you ever considered this option?

P.S. If you will stay in this forum you'll notice that members are often posting links for other members and...amazingly, the other ones are saying THANK YOU...until now I thought that was normal...Am I wrong :confused:
 
Not at all Suzy. You tried to help the guy and he threw it back in your face. I had the same thought earlier that the case is way too complicated. Last night there were 132 views and no replies. I think that should have told the OP that he probably won't get many responses....

To the OP: Suzy does try to help. She also has a sense of humor which comes across in her posts. She was not "sending you away". Guiding someone to a more helpful source is what people do here and if you can't see that, no one is going to bother with your posts.
 
I understand that she's trying to help. But if she could of explained her intention in a much more clear manner, it probably wouldnt have turned out to be like this. Obviously if u read her first post towards my situation, someone from my point of view could easily misinterpret and misunderstand that. Damage is done. Apologies to the affected.
 
If you meet the basic requirments of continous residence and physical presence, then go ahead and apply. Make sure that none of your trips were > 6 months in the last 5 yrs, if any trip was > 6 months, but < 1 yr, then it will be up to the interviewing officer. Take all the documentation to prove that you never abandoned the PR status.

Try you best to list all the trips abroad, based on you recollection and passport stamps. Attach an extra sheet of papers with an application.

With your case, you may be well advised to apply through an attorney.
 
I have been in the US since 1985. that was 20 years ago. unfortunately though, only the last 5 years count which was when i went out of the country to study. I think I have enough evidence to show my ties in the US and if i wanted to abandon my permanent residency, my family and I would have done that several years ago. My basic question now is: Has anyone heard of a similar case/situation who has through the naturalization process and was granted/was not granted citizenship?

Unfortunately, especially late after midnight, not to many people have the time and the patience to write 1,000 words essays.

When Suzy explained to you what she meant and that wasn't anything wrong with her post, you replied with this sarcastic message :rolleyes:

I would leverage off the fact that you are doing a lot of military work (presummably in support of the war efforts), and as a result may not meet the continuence requirement.

No INS officer of reasonable intelligence is going to decline your application without considering the special circumstance. If s/he did, I would start a letter campaign to all the public officials in your state, and the arms services comittee to raise hell on INS - not that they don't deserve it already.
 
I have met both the continuous and physical requirement to qualify for naturalization. It would just be fate if the interviewing officer would consider my situation. Well and also my ability to pursuade him/her my unintention to abandon residency. I will try. But if denied, then I kow at least "i tried".

Again, does any one know of a similar situation that has applied and was or was not granted naturalization?

You need to list all of your trips , you can use a seprate sheet ( make one) and give it to them. This is what i did.
