Hi, everyone,
I am kind of new here, I have a GC and I have one more year left for naturalization. Do you know when is the best time for me to apply for my wife to be here?(Send in all the forms). Other than I-130, what else do I need? Does she have to wait over her country until to get the A#??? I am appreciated for all you guys help. Thank you.

J.

Since you have just one more year for naturalization, I guess it would be best for you to get your citizenship and then file I-130 for your wife. Since she is not in the US, she will have to take CP route - ie she will need to stay in her country until the processing is complete after which she would get an immigrant visa and can travel to US. Looking at the current timelines, the processing approximately takes 3-4 months.

You can file the I-130 now, but it will take a long time for your priority date to become current - I believe you would get your citizenship sooner. Once you become a citizen, your wife will not have to wait for A# as it will be immediately available (A# is available immediately to the spouse of a USC).

Good Luck

Alternatively you can file I-130 now and later when you get your citizenship, you can upgrade your petition from that of an LPR to the petition of a US citizen. Either way, your wife will have to wait in her country until she gets the immigrant visa.

Thanks

Thanks. :) My wife is a student in canada right now, I guess I will wait till I get my citizenship, then I will filed the I-130 accroding to your opinion. Is she till have to go back to her country to get the A#? Or Once I filed the I-130, she can live with me??

Filing I-130 will not give her any immigrant/non-immgrant status, so she cannot travel to US. I guess you will have to keep visitng her in Canada until she gets the immigrant visa.

When you file the I-130 you will need to mention in the form City and Country of the American embassy/consulate where your wife will apply for the visa. This is where she will have to appear for the interview for the immigrant visa. I do not have a very good knowledge about the CP process so I am not sure if she can have her CP process done in Canada. Someone with a better knowledge may be able to help you. Try browsing the post in the AOS and CP thread to get more info on CP or you may post a separate thread to get better understanding of the CP process.
